Hamd kendisinden ba\u015fka ilah olmayan, mutlak manada tek g\u00fc\u00e7 ve kudret sahibi olan Allah\u2019a mahsustur. Salat ve selam t\u00fcm peygamberlerin ve onlar\u0131 takip eden tabilerinin \u00fczerine olsun.<\/strong><\/p>\n

\u015eer’\u00ee deliller, \u015fer’\u00ee h\u00fck\u00fcmleri \u00e7\u0131karma yollar\u0131. Edille, delil kelimesinin \u00e7o\u011fuludur. Delil de, kendisiyle, arzulanan bir amaca ula\u015f\u0131lan rehber, kaynak, dayanak demektir. Us\u00fbl-i Erbaa, Edille-i Erbaa da denir.<\/p>\n

Edille-i \u015eer’iyye, yahut \u015fer’\u00ee deliller, en genel anlamda \u0130sl\u00e2m hukukunun kaynaklar\u0131n\u0131 te\u015fkil eder. Di\u011fer bir ifadeyle, edille-i \u015fer’iyye, h\u00fck\u00fcm \u00e7\u0131karmada ba\u015fvurulan esaslar olarak ifade edilebilir. Kavram\u0131n ortaya \u00e7\u0131k\u0131\u015f\u0131 Etbau’t-T\u00e2biin devrinden sonrad\u0131r. \u00dczerinde d\u00fc\u015f\u00fcn\u00fclmesi veya kavran\u0131lmas\u0131yla, istenilen h\u00fckme ve sonuca ul\u00e2\u015ft\u0131r\u00e2n \u015feydir (Hayreddin Karaman, F\u0131k\u0131h Us\u00fbl\u00fc, 42). Kesin veya zann\u0131 olarak genel h\u00fck\u00fcm if\u00e2de eder.[1]<\/a><\/p>\n

Edille-i \u015eeriyye s\u0131ras\u0131yla; \u201cKitap, S\u00fcnnet, \u0130cma, K\u0131yas\u201dt\u0131r.<\/p>\n

\u015euras\u0131 muhakkakt\u0131r ki; bir m\u00fckellefin, lehindeki ve aleyhindeki haklar\u0131n\u0131 tesbit kat’i delillerle m\u00fcmk\u00fcnd\u00fcr. \u0130mam-\u0131 \u015eafii (rha): “Kat’i bir habere dayanmadan veya ictihad yapmadan bir s\u00f6z s\u00f6ylemek g\u00fcnaha \u00e7ok yak\u0131nd\u0131r. Allah\u00fb Te\u00e2la (cc) Res\u00fbl-i Ekrem (sav)’den ba\u015fka hi\u00e7 kimseye ilmi bir delile dayanmadan “Din” hususunda herhangi bir s\u00f6z s\u00f6yleme hakk\u0131 tan\u0131mam\u0131\u015ft\u0131r. \u0130lmi delil ise: Kitab, s\u00fcnnet, icma-i \u00fcmmet, asar ve mahiyetini beyana gayret etti\u011fim k\u0131yas-\u0131 fukaha’d\u0131r”buyuruyor. Dolay\u0131s\u0131yla; \u015fer’i herhangi bir delile dayanmadan din hususunda “\u015eahsi kanaat belirtmek” b\u00fcy\u00fck bir vebaldir.<\/p>\n

    \u0130sl\u00e2m ulem\u00e2s\u0131; m\u00fccerred olarak “Kitap” denildi\u011fi zaman bununla ancak Kur’an-\u0131 Kerim’in anla\u015f\u0131laca\u011f\u0131 hususunda m\u00fcttefiktirler. Kur’an-\u0131 Kerim’in ba\u015fka ba\u015fka y\u00f6nleri ve vas\u0131flar\u0131 ele al\u0131narak \u00e7e\u015fitli tarifleri yap\u0131lm\u0131\u015ft\u0131r. Genel olarak: “Allah\u00fb Te\u00e2la (cc) taraf\u0131ndan Cebrail vas\u0131tas\u0131 ile Peygamberimiz Res\u00fbl-i Ekrem (sav)’e indirilmi\u015f olan ve Res\u00fbl-i Ekrem (sav)’den bize tevat\u00fcren nakledilen bir naz\u0131m’d\u0131r\u201d tarifi uygun bulunmu\u015ftur. Bunun d\u0131\u015f\u0131nda: “Allah\u00fb Te\u00e2la (cc) taraf\u0131ndan Res\u00fbl-i Ekrem (sav)’e vahiy yoluyla indirilmi\u015f, mushaflarda yaz\u0131lm\u0131\u015f, tevat\u00fcrle nakledilmi\u015f, tilavetiyle taabb\u00fcd olunan muciz kel\u00e2md\u0131r” tarifi de yayg\u0131nd\u0131r.<\/p>\n

    Kur’an-\u0131 Kerim’in hem lafz\u0131, hem manas\u0131 Allah\u00fb Te\u00e2la (cc)’dand\u0131r. Bu hususta hi\u00e7bir be\u015ferin pay\u0131 yoktur. Kur’an-\u0131 Kerim’in bize ula\u015fmas\u0131 tevat\u00fcr yoluylad\u0131r ve indirildi\u011fi gibi eksiksiz olarak muhafaza edilmi\u015ftir. Ayet-i Kerime’lerin s\u00fbreler i\u00e7erisindeki yerleri de tevkifidir. Bu hususta hi\u00e7 kimsenin ictihad ve reyinden s\u00f6z etmek m\u00fcmk\u00fcn de\u011fildir. Mesel\u00e2: Harf-i Mukatta’dan “Elif-L\u00e2m-Mim” bir ayet-i kerime oldu\u011fu halde, “Elif-L\u00e2m-Ra” bir ayet de\u011fil, ayetten c\u00fczd\u00fcr. E\u011fer ictihad ve rey s\u00f6zkonusu olsayd\u0131, bu \u015fekilde de\u011ferlendirmek m\u00fcmk\u00fcn olmazd\u0131.<\/p>\n

    Bir mecliste Res\u00fbl-i Ekrem (sav): “\u00dcmmetimin hel\u00e2k\u0131 kitab’ta ve S\u00fbt’te olacakt\u0131r” buyurmu\u015ftur. Sahabe-i Kiram: “Ey Allah (cc)’\u0131n Res\u00fbl\u00fc, buradaki kitab ve S\u00fbt nedir?” diye sorunca, Res\u00fbl-i Ekrem (sav): “Kur’an-\u0131 Kerim’i \u00f6\u011frenip, O’nun ayetlerini Allah\u00fb Te\u00e2la (cc)’n\u0131n indirdi\u011fi gayeden ba\u015fka \u015fekilde te’vil etmektir” cevab\u0131n\u0131 vermi\u015ftir.Yine bir ba\u015fka Hadis-i \u015eerif’te: “Her kim Kur’an-\u0131 Kerim’i (Hi\u00e7bir ilmi olmadan) kendi \u015fahsi reyiyle tefsir ederse, cehennemdeki yerine haz\u0131rlans\u0131n”buyurdu\u011fu ve m\u00fc’minleri uyard\u0131\u011f\u0131 sabittir . \u0130mam-\u0131 \u015eafii (rha) “Allah\u00fb Te\u00e2la (cc)’n\u0131n kitab\u0131nda yer alan ilim, icma c\u00fcmlesindendir. Kur’an-\u0131 Kerim’in tamam\u0131, Arap lisan\u0131 \u00fczerine nazil buyurulmu\u015ftur. Bu sebeble Kur’an-\u0131 Kerim’in nasihi ve mens\u00fbhu, n\u00fcz\u00fbl sebebleri ve farz k\u0131ld\u0131klar\u0131, edebi bela\u011fat\u0131, ir\u015fad\u0131 ve m\u00fcbah k\u0131ld\u0131klar\u0131 iyi bilinmelidir. Ayr\u0131ca Allah\u00fb Te\u00e2la (cc)’n\u0131n peygamberine verdi\u011fi mevki’inin de iyi bilinmesi gerekir. Zira Allah\u00fb Te\u00e2la (cc)’n\u0131n kitab\u0131nda vaaz etti\u011fi h\u00fck\u00fcmleri Res\u00fbl-i Ekrem (sav)’in lisan\u0131 \u00fczere beyan buyurmu\u015ftur. Binaenaleyh Allah\u00fb Te\u00e2la (cc) farz olan h\u00fck\u00fcmlerle neyi kasdetmi\u015ftir? Kimin i\u00e7in farz k\u0131lm\u0131\u015ft\u0131r? B\u00fct\u00fcn insanlar bu farzlar\u0131n kapsam\u0131na giriyor mu, girmiyor mu? M\u00fckellef olan kullar\u0131n\u0131n neye itaat etmeleri gerekir ve neden sak\u0131nmalar\u0131 icabeder? B\u00fct\u00fcn bunlar\u0131n hepsi iyice bilinmelidir”diyerek, \u00f6nemli inceliklere i\u015faret etmi\u015ftir. Dolay\u0131s\u0131yla kat’i bir ilim olmadan, Kur’an-\u0131 Kerim’i tefsir etmek caiz de\u011fildir. Son y\u0131llarda bir\u00e7ok “Meal” yay\u0131nlanm\u0131\u015ft\u0131r. “Meal” kelimesi\u00a0 en yak\u0131n mana veya eksik olan terceme manas\u0131nad\u0131r. Hi\u00e7 kimse bu yay\u0131nlanan “Meal”ler ile amel edemez.<\/p>\n

    \u201c\u015e\u00fcphesiz, bu Kur’an, en do\u011fru yola iletir ve salih amellerde bulunan m\u00fc’minlere, onlar i\u00e7in ger\u00e7ekten b\u00fcy\u00fck bir ecir oldu\u011funu m\u00fcjde verir.\u201d (\u0130sra\/9)<\/p>\n

      \u00d6nce s\u00fcnnet kelimesi \u00fczerinde dural\u0131m. Lugat manas\u0131; “adet, makbul olsun veya olmas\u0131n takip edilen yol, y\u00fcz, yahut y\u00fcz\u00fcn g\u00f6r\u00fcnen k\u0131sm\u0131, siret, tabiat” manalar\u0131na gelir. Cahiliyye d\u00f6neminde Araplar “S\u00fcnnet” kelimesini takip edilen (\u00e7i\u011fnenmi\u015f)\u00a0 yol manas\u0131na kullan\u0131yor ve biliyorlard\u0131. Sahabe-i Kiram, Res\u00fbl-i Ekrem (sav)’in: “Size benim s\u00fcnnetime sar\u0131lman\u0131z\u0131 tavsiye ederim”emrini i\u015fitince, buradaki s\u00fcnnet lafz\u0131ndan “O’nun umumi ve hususi hayat\u0131ndaki davran\u0131\u015flar\u0131n\u0131 ifade etti\u011fini” bildikleri i\u00e7in hi\u00e7bir \u015fey sormam\u0131\u015flard\u0131r. \u00c7\u00fcnk\u00fc bu kelimeye yabanc\u0131 de\u011fillerdi.<\/p>\n

      \u0130sl\u00e2mi \u0131st\u0131l\u00e2h’ta S\u00fcnnet; “Res\u00fbl-i Ekrem (sav)’den sad\u0131r olan s\u00f6z, fiil ve takrirdir” \u015feklinde tarif olunmu\u015ftur.Hanefi f\u00fbkahas\u0131 amel a\u00e7\u0131s\u0131ndan s\u00fcnneti ikiye ay\u0131rm\u0131\u015ft\u0131r. Birincisi: Uyulmas\u0131 hidayet, terki ker\u00e2het ve is\u00e2et\u00a0 olan s\u00fcnnettir. Buna “S\u00fcnnet-i H\u00fcda” denilir. Mesel\u00e2: Ez\u00e2n, kamet, cemaat gibi, m\u00fctevatir haberlerle gelen s\u00fcnnetler bu s\u0131n\u0131fa dahildir. \u0130kincisi: Uyulmas\u0131 g\u00fczel, terki m\u00fcbah olan s\u00fcnnetlerdir.       \u0130mam-\u0131 \u015eafii (rha) kitap ve hikmet’in bir arada beyan edildi\u011fi ayet-i kerimeleri zikrettikten sonra \u015funlar\u0131 kaydediyor: “Bu ayet-i kerime’lerde Allah\u00fb Te\u00e2la (cc) “Kitap ve Hikmet’i” zikretmektedir. Kitap’tan maksad Kur’an-\u0131 Kerim’dir. Kur’an ilmine vak\u0131f, itimad etti\u011fim alimlere g\u00f6re hikmet ise Res\u00fbl-i Ekrem (sav)’in s\u00fcnnetidir. Zira Kur’an-\u0131 Kerim bir zikirdir. Hikmet ise ona tabi k\u0131l\u0131nm\u0131\u015ft\u0131r.       Meselenin \u00f6z\u00fc \u015fudur: Res\u00fbl-i Ekrem (sav)’in din hususundaki her emrine itaat etmek farzd\u0131r. Hi\u00e7 kimsenin, \u015fahsi kanaatini ve akl\u0131n\u0131 esas alarak muhalefet etmesi caiz de\u011fildir. S\u00fcnnet zanni de\u011fil, kat’i bir delildir. Hesap g\u00fcn\u00fcn\u00fc d\u00fc\u015f\u00fcnen bir m\u00fckellef, Res\u00fbl-i Ekrem (sav)’e muhalefet edemez.<\/p>\n

        \u00d6nce icma kelimesinin l\u00fbgat manas\u0131 \u00fczerinde dural\u0131m. \u0130cma Arap\u00e7a bir kelime olup; “azm, kasd ve ittifak”(59) manalar\u0131na gelir. Molla H\u00fcsrev: “M\u00fcctehid imamlar\u0131n herhangi bir as\u0131rda \u015fer’i bir h\u00fck\u00fcm \u00fczerinde ittifak etmelerine icma denir” tarifini esas alm\u0131\u015ft\u0131r. \u0130mam-\u0131 Serahsi’de \u015fu \u015fekilde tarif etmi\u015ftir: “Her as\u0131rda f\u0131sk\u0131n\u0131 il\u00e2n etmeyen, heva ve heveslerine tabi olmayan b\u00fct\u00fcn m\u00fcctehid imamlar\u0131n ittifak\u0131na icma denir.”<\/p>\n

(Fakat ahirette) kendisini cehenneme koyar\u0131z.\u00a0 O ne k\u00f6t\u00fc bir yerdir” (En Nisa S\u00fbresi:115)\u00a0 h\u00fckm\u00fc beyan buyurulmu\u015ftur. \u0130mam-\u0131 Zemah\u015feri:”Bu ayet , icma-\u0131 \u00fcmmetin delil oldu\u011funun i\u015faretidir. Zira\u00a0 ayette “peygambere muhalefet ile m\u00fc’minlerin yolunun d\u0131\u015f\u0131nda bir yol tutmak” ayn\u0131 mahiyette say\u0131lm\u0131\u015ft\u0131r.           K\u0131yas; Arap\u00e7a bir kelime olup “K-Y-S” k\u00f6k\u00fcnden\u00a0 (k\u00e2yese’nin) dili ge\u00e7mi\u015f masdar\u0131d\u0131r. Lugatta “iki \u015feyi birbiri ile \u00f6l\u00e7mek, mukayese atmak ve iki \u015fey aras\u0131naki benzerlikleri tesbit etmek ” anlam\u0131na gelir.F\u0131k\u0131h us\u00fbl\u00fc kitaplar\u0131nda; “kitap, s\u00fcnnet ve icma ile sabit olan bir h\u00fckm\u00fcn; illet ve sebeplerini dikkate alarak, hakk\u0131nda nass bulunmayan (fakat ayn\u0131 illetlere sahip olan) meselenin h\u00fckm\u00fcn\u00fc ortaya koymaya k\u0131yas denilir” tarifi yap\u0131lm\u0131\u015ft\u0131r. Hz. \u00f6mer (ra)’in\u00a0 Eb\u00fb Musa El E\u015f’ari’ye: “Birbirine benzeyen \u015feyleri iyi kavra, illet ve sebeblerini \u00e7ok hassas olarak tahlil et ve daha sonra k\u0131yas yap”tavsiyesinde, ayn\u0131 unsurlar g\u00f6r\u00fclmektedir.<\/p>\n

          Kur’an-\u0131 Kerim’de: “Onlara eminlik veya korku haberi geldi\u011fi zaman onu yay\u0131verirler. Halbuki o (haberi)\u00a0 peygambere ve i\u00e7lerinden \u00fbl\u00fb’lemr olanlara arzetseler, elbette bunlar\u0131n istinbata kadir olanlar\u0131 onu anlar, bilirlerdi” (En Nis\u00e2 S\u00fbresi: 83) h\u00fckm\u00fc beyan buyurulmu\u015ftur. Bu ayet-i Kerime’de ge\u00e7en “Yestenbit\u00fbneh\u00fb” ibaresinden kasd\u0131n, istinbat ve k\u0131yas yoluyla h\u00fck\u00fcm \u00e7\u0131karmak oldu\u011fu hususunda ittifak mevcuddur.Meselelerin ve haberlerin “Ul\u00fb’lemr” h\u00fckm\u00fcnde olan alimlere sorulmas\u0131 bir vecibedir.<\/p>\n

          Res\u00fbl-i Ekrem (sav), Hz. Muaz b. Cebel’i, “Yemen” iline vali olarak g\u00f6nderirken: “- Ya Muaz, bir hadise ile kar\u015f\u0131la\u015f\u0131rsan nas\u0131l h\u00fckmedeceksin?” diye sormu\u015ftur. Hz. Muaz b. Cebel (ra): “Allah\u00fb Te\u00e2la (cc)’n\u0131n kitab\u0131 ile ya Res\u00fblallah” diye cevap verir. Res\u00fbl-i Ekrem (sav): “- Peki h\u00fckm\u00fc kitap’ta bulamazsan nas\u0131l h\u00fckmedersin?” diye sordu. Hz. Muaz (ra): “Allah’\u0131n(cc) res\u00fbl\u00fc’n\u00fcn s\u00fcnnet’ine ba\u015fvururum” diye cevap verdi. Res\u00fbl-i Ekrem (sav): “Peki hem Allah\u00fb Te\u00e2la (cc)’n\u0131n kitab\u0131nda, hem Res\u00fbl\u00fc’n\u00fcn s\u00fcnnetinde bulamazsan nas\u0131l h\u00fckmedersin?” sualini sordu. Hz. Muaz (ra): “- O zaman reyimle (K\u0131yas yaparak) h\u00fckmederim”cevab\u0131n\u0131 verdi. Alemlere rahmet olarak g\u00f6nderilen Peygamberimiz Efendimiz (sav), Hz. Muaz b. Cebel (ra)’in bu cevab\u0131ndan memnun olmu\u015f ve: “Res\u00fblullah’\u0131n el\u00e7isini, Res\u00fblullah’\u0131 ho\u015fnud edecek \u015feye muvaffak k\u0131lan Allah\u00fb Te\u00e2la (cc)’ya hamd olsun” diye duada bulunmu\u015ftur. Bu hadis-i \u015ferif, bir cemaat taraf\u0131ndan rivayet edilmi\u015ftir.<\/p>\n

          K\u0131yas; kitap, s\u00fcnnet ve icma’ya ba\u011fl\u0131 olan, zanni bir delildir. Hakk\u0131nda muhkem ve m\u00fcfesser nass bulunan konularda k\u0131yas yap\u0131lamaz. M\u00fccmel olan haberlerde, k\u0131yas us\u00fbl\u00fc ile h\u00fck\u00fcm \u00e7\u0131kar\u0131l\u0131r.\u00a0 M\u00fcctehid seviyesinde ilme sahip olmayan kimseler; taharri (ara\u015ft\u0131rma) yapabilirler, fakat k\u0131yas ile h\u00fck\u00fcm veremezler.<\/p>\n

          Hanefi f\u00fbkahas\u0131: “Taabb\u00fcdi olan ve illetleri ak\u0131lla kavranamayan h\u00fck\u00fcmlerde k\u0131yas’\u0131n ge\u00e7erli olmayaca\u011f\u0131 hususunda” ittifak etmi\u015ftir.Mesel\u00e2: ibadetlerin biri, di\u011ferine k\u0131yas edilerek, yeni bir ibadet \u015fekli tayin edilemez.\u00a0 Ayr\u0131ca Hadd cezalar\u0131nda ve keffaretlerde, k\u0131yas yoluyla yeni\u00a0 h\u00fck\u00fcm\u00a0 konulamaz.<\/p>\n

          Kitap, s\u00fcnnet ve icma; her alanda delil oldu\u011fu halde, k\u0131yas-\u0131 fukaha sadece f\u0131khi meselelerde h\u00fcccet te\u015fkil eder. K\u0131yas-\u0131 fukaha; mutlak m\u00fcctehidler ile\u00a0 mezhepte veya meselede m\u00fcctehid olan fakihlerin\u00a0 ba\u015fvurabilece\u011fi bir kaynakt\u0131r. Herhangi bir mukallidin; akli melekelerini kullanarak yapm\u0131\u015f oldu\u011fu ak\u0131l y\u00fcr\u00fctme k\u0131yas-\u0131 fukaha olarak\u00a0 nitelendirilemez.. Bu nevi ak\u0131l y\u00fcr\u00fctmeler, \u015fahsi kanaat h\u00fckm\u00fcndedir. \u015eahsi kanaatlerini k\u0131yas kabul edenler, b\u00fcy\u00fck bir vebal ile kar\u015f\u0131-kar\u015f\u0131yad\u0131rlar. Nitekim Tabi\u00fbndan \u015ea’bi’ye bir kimse gelip bir mesele sorar. Hz. \u015ea’bi (rha); sualle ilgili olarak Abdullah \u0130bn-i Mes’ud (ra)’un bir rivayetini nakleder. Sual soran kimse: “- Sen bu konudaki \u015fahs\u0131 kanaatini s\u00f6yle” deyince, Hz. \u015ea’bi (rha): “- \u015eu adama bak\u0131n, ben ona Abdullah \u0130bn-i Mes’ud \u015f\u00f6yle dedi diyorum. O bana \u015fahsi kanaatimi soruyor. Ben dinimi bundan tenzih ederim. Vallahi m\u00fczikle me\u015fgul olmay\u0131, sana \u015fahsi kanaatimle fetva vermeye tercih ederim”diyerek, bir inceli\u011fe i\u015faret etmi\u015ftir.<\/p>\n

            Lugat manas\u0131 maslahat bulunan y\u00f6n\u00fc almak, bir \u015feyin isl\u00e2h\u0131n\u0131, d\u00fczeltilip iyi bir hale getirilmesini istemek manalar\u0131na gelir. “Salaha” k\u00f6k\u00fcnden gelen maslahat; iyi olma, d\u00fczelme, elveri\u015fli bulunma manas\u0131nad\u0131r. Z\u0131dd\u0131 ise “Fesede” k\u00f6k\u00fcnden gelen mefsedettir.Kur’an-\u0131 Kerim’de: “…O kendilerine iyili\u011fi emrediyor, onlar\u0131 k\u00f6t\u00fcl\u00fckten nehyediyor.             \u00d6nce l\u00fbgat manas\u0131 \u00fczerinde dural\u0131m. \u00d6rf kelimesi; ma’ruf ve\u00a0 irfan ile ilgili olup, “irfan ehlinin raz\u0131 oldugu davran\u0131\u015flar” manas\u0131nad\u0131r. \u0130mam-\u0131 Kurtubi:”-Selim ak\u0131l sahiplerinin raz\u0131 oldu\u011fu ve insanlar\u0131 mutmain eden davran\u0131\u015flara \u00f6rf denilir” tarifini yapm\u0131\u015ft\u0131r. Yayg\u0131n olan tarif \u015fudur: “\u015eer’i \u015ferife ayk\u0131r\u0131 olmayan ve akl-\u0131 selim sahibi kimselerin m\u00fcstahsen buldu\u011fu davran\u0131\u015flara \u00f6rf denilir.” \u00d6rf ve \u00e2det’te dikkat edilecek husus “\u015eer’an ve aklen m\u00fcstahsen” olmas\u0131d\u0131r.Buna sahih \u00f6rf denilmi\u015ftir. \u015eer’i \u015ferife uygun olmayan \u00f6rfe, “fasid \u00f6rf” denilir. Fasid \u00f6rf, delil olarak kabul edilemez.Nasslar ile \u00f6rf ve adetler tearuz (\u00e7eli\u015fki) s\u00f6konusu olursa, nasslar esas al\u0131n\u0131r.Bu durumda, \u00f6rfe ve adete itibar edilemez.<\/p>\n

            \u0130ST\u0130HSAN: <\/strong><\/p>\n
