Hamd kendisinden ba\u015fka ilah olmayan, mutlak manada tek g\u00fc\u00e7 ve kudret sahibi olan Allah(Celle Celaluhu)\u2019a mahsustur. Salat ve selam t\u00fcm peygamberlerin ve onlar\u0131 takip eden tabilerinin \u00fczerine olsun<\/strong><\/p>\n

4- \u0130nkar edenlerle kar\u015f\u0131la\u015ft\u0131\u011f\u0131n\u0131z zaman boyunlar\u0131n\u0131 vurun. Nihayet onlar\u0131 iyice vurup sindirince ba\u011f\u0131 s\u0131k\u0131ca ba\u011flay\u0131n (onlar\u0131 esir al\u0131n). Sava\u015f sona erince de art\u0131k ya kar\u015f\u0131l\u0131ks\u0131z veya fidye kar\u015f\u0131l\u0131\u011f\u0131 sal\u0131verin. Allah dileseydi onlardan ba\u015fka t\u00fcrl\u00fc de \u00f6\u00e7 alabilirdi. Bunun \u00f6yle olmas\u0131 kiminizi kiminizle denemek i\u00e7indir. Ancak kendi yolunda \u00f6lenlerin yapt\u0131klar\u0131n\u0131 bo\u015fa \u00e7\u0131karmaz.<\/em><\/strong><\/p>\n

Bu ayette “kar\u015f\u0131la\u015fmak”tan gaye; inanmayanlarla sava\u015f ve \u00e7arp\u0131\u015fmak \u00fczere kar\u015f\u0131 kar\u015f\u0131ya gelmektir. Yoksa hedefsiz olarak sadece kar\u015f\u0131la\u015fmak de\u011fildir. Bu sure inene kadar Arap yar\u0131madas\u0131nda m\u00fc\u015friklerin bir k\u0131sm\u0131 m\u00fcsl\u00fcmanlarla sava\u015f halinde, bir k\u0131sm\u0131 da adla\u015fmal\u0131 idiler. Ve hen\u00fcz Berae (Tevbe suresi) inmemi\u015fti. Bu sure, m\u00fc\u015friklerle belirli s\u00fcre ile s\u0131n\u0131rl\u0131 olarak yap\u0131lan antla\u015fmalar\u0131 o s\u00fcrenin sonuna kadar ge\u00e7erli sayarken herhangi bir s\u00fcre ile s\u0131n\u0131rl\u0131 olmayan antla\u015fmalar i\u00e7in d\u00f6rt ayl\u0131k bir s\u00fcre tan\u0131yordu. Ya da m\u00fc\u015friklerin islama girmeleri gerekiyordu. Bundan hedef ise kural\u0131 art\u0131k islam\u0131n belirlemesi gerekti\u011fi idi.<\/p>\n

\u0130nan\u00e7s\u0131zlarla kar\u015f\u0131la\u015f\u0131ld\u0131\u011f\u0131 zaman emredilen boyun vurma do\u011fal olarak kendilerine islama girmeleri teklif edildikten ve onlar\u0131n da girmekten ka\u00e7\u0131nmalar\u0131ndan sonra s\u00f6zkonusudur. Bu ayet surenin sava\u015f atmosferine ve \u00e7a\u011fr\u0131\u015f\u0131mlar\u0131na uygun olarak, \u00f6ld\u00fcrme i\u015flemini do\u011frudan do\u011fruya d\u0131\u015fa vuran \u015fekli ile ve bu \u00f6ld\u00fcrmeyi simgeleyen hareketle canland\u0131rmaktad\u0131r.<\/p>\n

“Nihayet onlar\u0131 iyice vurup sindirince ba\u011f\u0131 s\u0131k\u0131ca ba\u011flay\u0131n (onlar\u0131 esir al\u0131n).”<\/strong><\/p>\n

Ayette ge\u00e7en “ishan” d\u00fc\u015fman\u0131 \u00f6ld\u00fcrmekte a\u015f\u0131r\u0131 gitmektir. Bundan hedef ise d\u00fc\u015fman\u0131n g\u00fcc\u00fcn\u00fc kuvvetini k\u0131rmak, birbiri ard\u0131 s\u0131ra k\u0131r\u0131l\u0131p \u00f6lmesini sa\u011flamakt\u0131r. Ki art\u0131k bir daha d\u00fc\u015fman kendisine gelip de sald\u0131racak ya da kendini savunacak g\u00fcc\u00fc bulamas\u0131n… \u0130\u015fte o zaman -bundan \u00f6nce de\u011fil- esir d\u00fc\u015fen tutsak edilir ve kelep\u00e7esi s\u0131k\u0131 tutulur. Ama d\u00fc\u015fman hala g\u00fcc\u00fcn\u00fc yitirmemi\u015fse “ishan” ve \u00f6ld\u00fcrmede a\u015f\u0131r\u0131 gitme bu tehlikeyi k\u0131rmak i\u00e7in ana hedef olarak kal\u0131r. Buna g\u00f6re, bu ayetin anlam\u0131 ile y\u00fcce Allah’\u0131n Bedir sava\u015f\u0131nda d\u00fc\u015fman\u0131 \u00f6ld\u00fcrmek yerine \u00e7ok esir ald\u0131klar\u0131ndan dolay\u0131 Peygamberini ve m\u00fcsl\u00fcmanlar\u0131 azarlay\u0131p \u00e7\u0131k\u0131\u015ft\u0131\u011f\u0131 Enfal suresinin ayetleri aras\u0131nda \u00e7eli\u015fki olmaz. O zaman kafirleri \u00f6ld\u00fcrmek daha uygundu. Nitekim o ayette y\u00fcce Allah:<\/p>\n

“Yery\u00fcz\u00fcnde \u00fcst\u00fcnl\u00fc\u011f\u00fcn\u00fc per\u00e7inlemedik\u00e7e hi\u00e7bir Peygamberin esir almas\u0131 yerinde de\u011fildir. Siz ge\u00e7ici d\u00fcnya mal\u0131n\u0131 istiyorsan\u0131z. Oysa Allah sizin hesab\u0131n\u0131za ahireti istiyor. Allah \u00fcst\u00fcn iradeli ve hikmet sahibidir. E\u011fer Allah’\u0131n daha \u00f6nce kesinle\u015fmi\u015f (ve bu konuda lehinize i\u015fleyen) bir h\u00fckm\u00fc olmasayd\u0131 esirlerin kar\u015f\u0131l\u0131\u011f\u0131nda ald\u0131\u011f\u0131n\u0131z fidyeler y\u00fcz\u00fcnden ba\u015f\u0131n\u0131za b\u00fcy\u00fck bir azap gelirdi” <\/strong>(Enfal suresi 67-68). \u00d6ncelikle, d\u00fc\u015fman\u0131n g\u00fcc\u00fcn\u00fc ve kuvvetini k\u0131rmak i\u00e7in “ishan” gerekir. Esir almak bundan sonraki a\u015famada s\u00f6zkonusudur. Bunun nedeni gayet a\u00e7\u0131kt\u0131r. \u00c7\u00fcnk\u00fc islama d\u00fc\u015fman ve sald\u0131rgan olan g\u00fcc\u00fcn ortadan kald\u0131r\u0131lmas\u0131 sava\u015f\u0131n ilk hedefidir. Hele hele, \u0130slam toplumunun say\u0131sal g\u00fcc\u00fc az ve s\u0131n\u0131rl\u0131 ve \u00e7o\u011funluk m\u00fc\u015friklerin yan\u0131nda ise, m\u00fc\u015friklerden bir tek eli silahl\u0131 askerin saf d\u0131\u015f\u0131 edilmesi bile -o zamanlar oldu\u011fu gibi- g\u00fc\u00e7 dengesi a\u00e7\u0131s\u0131ndan \u00e7ok b\u00fcy\u00fck \u00f6nem ta\u015f\u0131yorsa daha da \u00f6ncelik kazan\u0131r. Bu h\u00fck\u00fcm, genel anlam\u0131 ile her zaman, d\u00fc\u015fman\u0131n g\u00fcc\u00fcn\u00fc kuvvetini k\u0131rmay\u0131 ve d\u00fc\u015fman\u0131 hem sald\u0131r\u0131 hem de savunma yapamayacak \u015fekilde g\u00fc\u00e7s\u00fcz b\u0131rakmay\u0131 sa\u011flayacak bi\u00e7imi ile hala ge\u00e7erlidir. Bundan sonra esirler hakk\u0131ndaki h\u00fckme gelince, bu ayet o h\u00fck\u00fcmleri, belirlemektedir. Nitekim bu ayet esirlere dair h\u00fck\u00fcmleri i\u00e7eren biricik Kur’an ayetidir:<\/p>\n

“Sava\u015f sona erince de art\u0131k ya kar\u015f\u0131l\u0131ks\u0131z veya fidye kar\u015f\u0131l\u0131\u011f\u0131 sal\u0131verin.”<\/strong><\/p>\n

Yani, d\u00fc\u015fman askeri esir al\u0131nd\u0131ktan sonra ya herhangi bir kar\u015f\u0131l\u0131k al\u0131nmadan sal\u0131verilir. Onlardan bu sal\u0131verme kar\u015f\u0131l\u0131\u011f\u0131 herhangi bir mal al\u0131nmad\u0131\u011f\u0131 gibi, bunlar\u0131n kar\u015f\u0131l\u0131\u011f\u0131nda m\u00fcsl\u00fcman esir kurtar\u0131lmas\u0131na gidilmez. Ya da fidye kar\u015f\u0131l\u0131\u011f\u0131 sal\u0131verilir. Bu fidye bir mal olabilir, bir \u00e7al\u0131\u015ft\u0131rma zorunlulu\u011fu olabilir, tutsak d\u00fc\u015fen m\u00fcsl\u00fcmanlar\u0131n sal\u0131verilmeleri kar\u015f\u0131l\u0131\u011f\u0131 olabilir.<\/p>\n

Bu ayette m\u00fc\u015frik tutsaklar i\u00e7in \u00f6ld\u00fcr\u00fclme ya da k\u00f6lele\u015ftirilme gibi \u00fc\u00e7\u00fcnc\u00fc bir ihtimal s\u00f6zkonusu edilmiyor.<\/p>\n

Ancak bir uygulama bi\u00e7imi olarak g\u00f6rd\u00fc\u011f\u00fcm\u00fcz \u015fu ki; Resulullah ve kendisinden sonra gelen halifeler -\u00e7o\u011funlukla- tutsaklar\u0131 k\u00f6le edinmi\u015fler baz\u0131 belirli durumlarda ise \u00f6ld\u00fcr\u00fclm\u00fc\u015flerdir. ,<\/p>\n

Biz burada bu ayetle ilgili olarak Hanefi bilgin \u0130mam Cessas”\u0131n Ahkamul Kur’an isimli eserinde yer alan a\u00e7\u0131klamalar\u0131 aktaracak, arada a\u00e7\u0131klamay\u0131 uygun g\u00f6rd\u00fc\u011f\u00fcm\u00fcz noktalarda a\u00e7\u0131klama yapaca\u011f\u0131z. Sonra da bu konuda d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fcm\u00fcz h\u00fckm\u00fc belirtece\u011fiz.<\/p>\n

Allah Teala “\u0130nkar edenlerle kar\u015f\u0131la\u015ft\u0131\u011f\u0131n\u0131z zaman boyunlar\u0131n\u0131 vurun” <\/strong>buyurmaktad\u0131r. Ebu Bekr Cessas der ki: “Bu ayetin s\u00f6zc\u00fck ve c\u00fcmlelerinin yans\u0131tt\u0131\u011f\u0131 anlam tutsaklar\u0131n \u00f6ld\u00fcr\u00fclmesini gerektirir. Bundan ba\u015fka bir \u00e7\u00f6z\u00fcm yoktur. Ve yine dilerlerse tutsaklar\u0131n verece\u011fi fidyeyi kabul edip onlar\u0131 serbest b\u0131rak\u0131rlar. Ebu Ubeyd “Dilerlerse k\u00f6le edinirler” ifadesini s\u00f6ylemedi\u011finde ku\u015fku duymu\u015ftur. (K\u00f6le edinme konusunun \u0130bn-i Abbas taraf\u0131ndan s\u00f6ylenmedi\u011fi hakk\u0131nda ku\u015fku vard\u0131r, bu nedenle onu bir yana b\u0131rak\u0131yoruz. “Biz diyoruz ki: M\u00fc\u015friklerin ele ge\u00e7irildi\u011fi yerde \u00f6ld\u00fcr\u00fclmelerinin emredilmesi Arap yar\u0131madas\u0131 m\u00fc\u015friklerine \u00f6zg\u00fcd\u00fcr. Oysa Muhammed suresindeki ayet \u00f6zel bir durum i\u00e7in de\u011fil, aksine her t\u00fcrl\u00fc durumlar i\u00e7in amel edilmesi gereken bir h\u00fck\u00fcm ifade eder. Yery\u00fcz\u00fcnde inan\u00e7s\u0131zlar\u0131 tamamen yenip g\u00fc\u00e7s\u00fcz duruma getirince art\u0131k esir almak caiz olur. Resulullah’dan sonra devlet ba\u015fkan\u0131 olan halifelerin uygulamalar\u0131 b\u00f6yle idi. Do\u011fal olarak Berae (Tevbe) suresi indikten sonra da uygulama b\u00f6yle olmu\u015ftu. ve m\u00fcsl\u00fcmanlar baz\u0131 belirli durumlar hari\u00e7 tutulan tutsaklar\u0131 \u00f6ld\u00fcrmemi\u015flerdir. Buna ilerde de\u011finece\u011fiz.”<\/p>\n

“Onlar\u0131 kar\u015f\u0131l\u0131ks\u0131z veya fidye kar\u015f\u0131l\u0131\u011f\u0131 sal\u0131verin” <\/strong>ayetine gelince… Bu ayetin akla ilk anda gelen d\u0131\u015f anlam\u0131 iki se\u00e7enekten birisini uygulamay\u0131 gerektiriyor. Arap yar\u0131madas\u0131 d\u0131\u015f\u0131ndaki \u00f6nemli \u015fehirlerin \u0130slam hukuk\u00e7ular\u0131 bu konuda g\u00f6r\u00fc\u015f birli\u011fi i\u00e7indedirler. “\u0130slam hukuk\u00e7ular\u0131n\u0131n g\u00f6r\u00fc\u015f ayr\u0131l\u0131\u011f\u0131na d\u00fc\u015ft\u00fckleri konu, tutsaklar\u0131n verecekleri fidyelerin kabul edilip sal\u0131verilmesi konusudur. B\u00fct\u00fcn imamlar\u0131m\u0131z (yani Hanefi alimleri) derler ki: Sava\u015f tutsa\u011f\u0131ndan mal al\u0131narak sal\u0131verilmez ve tutsaklar d\u00fc\u015fmana da sat\u0131lamaz, \u00e7\u00fcnk\u00fc bu durumda yeniden vurucu g\u00fc\u00e7 olarak kar\u015f\u0131m\u0131za dikilirler. Ebu Hanife: Sava\u015f tutsaklar\u0131 m\u00fcsl\u00fcman tutsaklar\u0131n kar\u015f\u0131l\u0131\u011f\u0131nda da sal\u0131verilemez. Sava\u015f tutsaklar\u0131na d\u00fc\u015fman saflar\u0131na kat\u0131l\u0131p da vurucu g\u00fc\u00e7 olarak kar\u015f\u0131m\u0131za dikilme imkan\u0131 verilemez der. Ebu Yusuf ve \u0130mam Muhammed: Sava\u015f tutsaklar\u0131n\u0131n m\u00fcsl\u00fcman tutsaklarla de\u011fi\u015f-toku\u015f edilmelerinde bir sak\u0131nca yoktur derler. Sevri ve Evzai de ayn\u0131 g\u00f6r\u00fc\u015ftedirler. Evzai derki: “Tutsaklar\u0131n d\u00fc\u015fmana sat\u0131lmas\u0131nda bir sak\u0131nca yoktur. Erkek tutsaklar ancak m\u00fcsl\u00fcman tutsaklarla de\u011fi\u015ftirilirler.” M\u00fczeni \u015eafii’nin \u015fu fetvas\u0131n\u0131 nakleder: “Devlet ba\u015fkan\u0131 yenmi\u015f oldu\u011fu sava\u015f tutsaklar\u0131n\u0131 kar\u015f\u0131l\u0131ks\u0131z serbest b\u0131rakabilece\u011fi gibi, onlardan fidye alarak da kendilerini sal\u0131verebilir.”<\/p>\n

Sava\u015f tutsaklar\u0131n\u0131 bir mal ya da m\u00fcsl\u00fcman tutsaklar\u0131n kar\u015f\u0131l\u0131\u011f\u0131nda sal\u0131vermek caizdir diyenler, “Onlar\u0131 ya kar\u015f\u0131l\u0131ks\u0131z ya da fidye kar\u015f\u0131l\u0131\u011f\u0131 sal\u0131verin” <\/strong>ayetini delil olarak g\u00f6sterirler. Ayetin ilk anda akla gelen anlam\u0131, tutsaklar\u0131n bir mal kar\u015f\u0131l\u0131\u011f\u0131 ya da m\u00fcsl\u00fcman tutsaklarla de\u011fi\u015ftirilerek sal\u0131verilmelerini gerektirir. Ve Resulullah Bedir tutsaklar\u0131n\u0131 mal kar\u015f\u0131l\u0131\u011f\u0131 sal\u0131vermi\u015ftir. \u0130slam hukuk\u00e7ular\u0131 tutsaklar\u0131n m\u00fcsl\u00fcman tutsaklar kar\u015f\u0131l\u0131\u011f\u0131 sal\u0131verilmesinin caiz oldu\u011funa delil olarak \u015fu hadisi g\u00f6sterirler. \u0130bn-i M\u00fcbarek, Ma’mer, Eyy\u00fcb, Ebu K\u0131labe Ebu`l Muhalleb, H\u00fcseyin o\u011flu \u0130mran kanal\u0131 ile \u015fu olay\u0131 anlat\u0131r: \u0130mran der ki: Sakifliler Resulullah’\u0131n sahabelerinden iki ki\u015fiyi tutsak ederler. Resulullah’\u0131n sahabeleri de Amir b. Sa’sa o\u011fullar\u0131ndan birisini tutsak eder. Resulullah adam\u0131n yan\u0131na yakla\u015f\u0131r. Kendisi ba\u011fl\u0131d\u0131r. Resulullah’a seslenince, Resulullah adam\u0131n yan\u0131na y\u00f6nelir. Tutsak: “Ben ni\u00e7in hapsolunuyorum deyince Resulullah. “Yanda\u015flar\u0131n\u0131n i\u015fledi\u011fi su\u00e7tan dolay\u0131” buyurur. Tutsak: “Ben m\u00fcsl\u00fcman oluyorum, deyince Resulullah: “Sen bu s\u00f6z\u00fc, \u00f6zg\u00fcrl\u00fc\u011f\u00fcn elinde iken s\u00f6ylemi\u015f olsayd\u0131n, tam anlam\u0131 ile kurtulmu\u015f olurdun” der. Resulullah ilerleyince tutsak yine ona seslenir: “A\u00e7\u0131m doyur beni” der. Resulullah: “Tamam bu senin ihtiyac\u0131nd\u0131r” der. Sonra Resulullah bu adam\u0131 Sakiflilerin tutsak ettikleri iki ki\u015fi ile de\u011fi\u015ftirerek sal\u0131verir. Tutsaklar fidye kar\u015f\u0131l\u0131\u011f\u0131 sal\u0131verilir diyen hukuk\u00e7ular\u0131n delilleri bize g\u00f6re, sava\u015f tutsaklar\u0131 mal veya m\u00fcsl\u00fcman tutsaklar kar\u015f\u0131l\u0131\u011f\u0131nda sal\u0131verilirler konusundaki ihtilafl\u0131 g\u00f6r\u00fc\u015flere sahip olan \u0130mam Cessas’\u0131n imamlar\u0131n\u0131n delillerinden daha g\u00fc\u00e7l\u00fcd\u00fcr.”<\/p>\n

\u0130mam Cessas bu konudaki s\u00f6z\u00fc kendi mezhebinden olan Hanefi imamlar\u0131n g\u00f6r\u00fc\u015flerini tercih ederek bitiriyor. Ve \u015f\u00f6yle diyor: Ayette yer alan tutsaklar\u0131 “Kar\u015f\u0131l\u0131ks\u0131z sal\u0131verme ya da fidye alarak serbest b\u0131rakma”<\/strong>ya bir de Bedir tutsaklar\u0131n\u0131n fidye kar\u015f\u0131l\u0131\u011f\u0131 sal\u0131verilmeleri konusuna gelince; Bunlar\u0131n, “M\u00fc\u015frikleri buldu\u011funuz yerde \u00f6ld\u00fcr\u00fcn\u00fcz. Yakalay\u0131p hapsediniz. B\u00fct\u00fcn muhtemel ge\u00e7itleri tutup onlar\u0131 g\u00f6zetleyiniz. E\u011fer tevbe eder de namaz k\u0131lar ve zekat verirlerse onlar\u0131 sal\u0131veriniz.” (Tevbe suresi, 5) <\/strong>ayeti ile h\u00fck\u00fcmleri y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lm\u0131\u015ft\u0131r. Buna dair bir nakil de S\u00fcddi’den ve \u0130bn-i C\u00fcreyc’den naklettik. “Allah’a ve ahiret g\u00fcn\u00fcne inanmayan Allah’\u0131n ve Peygamberinin haram k\u0131ld\u0131\u011f\u0131 \u015feyleri haram saymayan ve ger\u00e7ek dini benimsemeyen yahudi ve hristiyanlar ile bunlar, size boyun e\u011fip kendi elleri ile cizye verene dek sava\u015f\u0131n\u0131z.” <\/strong>(Tevbe suresi, 29<\/strong>) ayeti kafirlerle m\u00fcsl\u00fcman oluncaya veya cizye verinceye kadar sava\u015fmay\u0131 i\u00e7erir. Sava\u015f tutsaklar\u0131ndan mal alarak ya da ba\u015fka bir\u015fey kar\u015f\u0131l\u0131\u011f\u0131 onlar\u0131 sal\u0131vermek bu ayete ayk\u0131r\u0131d\u0131r. Gerek Kur’an tefsircileri gerekse Hadis rivayet edenler Tevbe suresinin Muhammed suresinden sonra indi\u011fi konusunda g\u00f6r\u00fc\u015f ayr\u0131l\u0131\u011f\u0131na d\u00fc\u015fmemi\u015flerdir. \u015eu halde tevbe suresinin ayetinde yer alan h\u00fckm\u00fcn ba\u015fka ayetlerde ge\u00e7en tutsaklar\u0131n fidye kar\u015f\u0131l\u0131\u011f\u0131 sal\u0131verilmesi h\u00fckm\u00fcn\u00fc y\u00fcr\u00fcrl\u00fckten kald\u0131rmas\u0131 gerekir.<\/p>\n

Daha \u00f6nce de s\u00f6z edildi\u011fi \u00fczere, m\u00fc\u015friklerin \u00f6ld\u00fcr\u00fclmeleri ya da islama girmeleri h\u00fckm\u00fc Arap yar\u0131madas\u0131nda ya\u015fayan m\u00fc\u015friklerle ilgilidir. Bu onlara \u00f6zel bir h\u00fck\u00fcmd\u00fcr. Yar\u0131mada d\u0131\u015f\u0131nda \u00f6teki m\u00fc\u015friklerden ise, yahudi ve H\u0131ristiyanlardan al\u0131nd\u0131\u011f\u0131 gibi cizye al\u0131n\u0131r. Sava\u015f\u00e7\u0131lar teslim olduklar\u0131 zaman onlardan cizye kabul edilmesi, \u00f6nce m\u00fcsl\u00fcmanlar\u0131n ellerine esir d\u00fc\u015fmeyecekler demek de\u011fildir. Tutsaklar hakk\u0131nda h\u00fck\u00fcm nedir? diye sorulacak olursa deriz ki: Devlet ba\u015fkan\u0131 yararl\u0131 g\u00f6r\u00fcrse tutsaklar\u0131 kar\u015f\u0131l\u0131ks\u0131z, ya da fidye alarak mal veya m\u00fcsl\u00fcman tutsaklar kar\u015f\u0131l\u0131\u011f\u0131 onlar\u0131 sal\u0131verebilir. Bu uygulama d\u00fc\u015fman taraf\u0131 hen\u00fcz g\u00fcc\u00fcn\u00fc koruyorsa, teslim olup da cizye vermeyi kabul etmemi\u015fse ge\u00e7erlidir. Ama teslim olmu\u015flar da cizye vermeyi kabul etmi\u015flerse, do\u011fal olarak problem sona ermi\u015ftir.<\/p>\n

Bu ba\u015fka bir durumdur. Tutsak h\u00fck\u00fcmleri, i\u015f cizye vermeye kadar varmad\u0131k\u00e7a ge\u00e7erlili\u011fini koruyacakt\u0131r.<\/p>\n

\u00d6zet olarak bizim ula\u015ft\u0131\u011f\u0131m\u0131z sonu\u00e7, bu ayetin tutsaklar\u0131n durumunu d\u00fczenleyen biricik ayet oldu\u011fudur. \u00d6teki ayetler, tutsakl\u0131k durumundan ba\u015fka durumlar\u0131 d\u00fczenler. Bu ayet ise, bu konu ile ilgili s\u00fcrekli uygulanmak \u00fczere getirilmi\u015f bir prensiptir. Bu prensibe ayk\u0131r\u0131 olarak yap\u0131lm\u0131\u015f uygulamalar ise, bu prensibin d\u0131\u015f\u0131nda, \u00f6zel durumlar ve gelip ge\u00e7ici \u015fartlar kar\u015f\u0131s\u0131nda ba\u015fvurulmu\u015f uygulamalard\u0131r. \u00d6zel durumlarda baz\u0131 sava\u015f tutsaklar\u0131n\u0131n \u00f6ld\u00fcr\u00fclmelerinin ise, her zaman benzeri g\u00f6r\u00fclebilecek olan ki\u015fisel sebebler olmu\u015ftur. \u00d6ld\u00fcr\u00fclen tutsaklar m\u00fcsl\u00fcmanlarla sava\u015fa giri\u015ftikleri i\u00e7in de\u011fil, tutsak d\u00fc\u015fmeden \u00f6nceki sab\u0131kalar\u0131ndan dolay\u0131 cezaland\u0131r\u0131lm\u0131\u015flard\u0131r. Buna \u00f6rnek olarak yarg\u0131lanmas\u0131n\u0131 verebiliriz. Bu durumda tutsak etmek kendisini yakalamak i\u00e7in s\u0131rf bir ara\u00e7 olarak kal\u0131r.<\/p>\n

Geriye k\u00f6lele\u015ftirme konusu kald\u0131. Biz bu tefsirin de\u011fi\u015fik yerlerinde bu konudan s\u00f6z ettik ve dedik ki: K\u00f6lele\u015ftirme o zamanlar d\u00fcnyada g\u00f6r\u00fclen bir durum ve genel olarak sava\u015flarda uygulanan bir gelenekti. \u0130slam d\u00fc\u015fmanlar\u0131 tutsak ettikleri m\u00fcsl\u00fcmanlar\u0131 birer birer k\u00f6le edinirken, \u0130slam dini her durumda genel anlaml\u0131 “Ya kar\u015f\u0131l\u0131ks\u0131z veya fidye kar\u015f\u0131l\u0131\u011f\u0131 sal\u0131verin” <\/strong>ayetini uygulayamazd\u0131. Dolay\u0131s\u0131 ile, Resulullah baz\u0131 durumlarda bu ayeti uygulam\u0131\u015f ve baz\u0131 tutsaklar\u0131 kar\u015f\u0131l\u0131ks\u0131z sal\u0131vermi\u015ftir. Bir k\u0131sm\u0131n\u0131 da m\u00fcsl\u00fcman tutsaklarla de\u011fi\u015firken baz\u0131lar\u0131n\u0131 verecekleri mal kar\u015f\u0131l\u0131\u011f\u0131 sal\u0131vermi\u015ftir. Ba\u015fka baz\u0131 durumlarda, k\u00f6lele\u015ftirme uygulamas\u0131na ba\u015fvurulmu\u015ftur. Birg\u00fcn gelir de b\u00fct\u00fcn bloklar tutsaklar\u0131n k\u00f6lele\u015ftirilmemeleri \u00fczerinde g\u00f6r\u00fc\u015f birli\u011fine var\u0131rlarsa, o zaman \u0130slam da biricik olumlu prensibine, “Ya kar\u015f\u0131l\u0131ks\u0131z veya fidye kar\u015f\u0131l\u0131\u011f\u0131 sal\u0131verin” <\/strong>prensibine geri d\u00f6ner. \u00c7\u00fcnk\u00fc k\u00f6lele\u015ftirmeyi gerektiren \u015fartlar ortadan kalkm\u0131\u015ft\u0131r art\u0131k. O halde k\u00f6lele\u015ftirme kesin olarak uygulanmas\u0131 gereken bir kural ve islamda tutsaklara yap\u0131lacak i\u015flemlerden birisi de\u011fildir.<\/p>\n

Kur’an’\u0131n kesin ifadesinden, olaylar\u0131n, durumlar\u0131n ve \u015fartlar\u0131n incelenmesinden elde etti\u011fimiz g\u00f6r\u00fc\u015f budur. Do\u011fruya ula\u015ft\u0131ran da yaln\u0131z Allah’t\u0131r.<\/p>\n

\u015eu noktan\u0131n anla\u015f\u0131lmas\u0131nda yarar g\u00f6r\u00fcyorum. Benim bu g\u00f6r\u00fc\u015fe varmam Kur’an ayetlerinin, olaylar\u0131n ve \u015fartlar\u0131n incelenmesinden ortaya \u00e7\u0131kan sonu\u00e7lar\u0131n bu g\u00f6r\u00fc\u015f\u00fc g\u00fc\u00e7lendirmesinden dolay\u0131d\u0131r. Yoksa tutsaklar\u0131 k\u00f6lele\u015ftirmeyi, islama y\u00f6nelik bir leke kabul edip de onu islamdan temizlemeye \u00e7al\u0131\u015fmak akl\u0131m\u0131n ucundan bile ge\u00e7mi\u015f de\u011fildir. B\u00f6yle bir d\u00fc\u015f\u00fcnce asla akl\u0131mdan ge\u00e7mez. \u0130slam\u0131n d\u00fc\u015f\u00fcncesi tutsaklar\u0131 k\u00f6lele\u015ftirmek olsa idi hay\u0131rl\u0131 olan budur derdim. \u00c7\u00fcnk\u00fc terbiyeden en ufak bir k\u0131r\u0131nt\u0131 kadar nasip alm\u0131\u015f bir insan, Allah’tan daha iyisini d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fcn\u00fc s\u00f6yleyemez. Ben ise Kur’an ayetleri ile ve o ayetlerin ruhu y\u00f6n\u00fcnde hareket ediyorum. Ayetler ile ve onlar\u0131n hedefleri ile bu s\u0131ralad\u0131\u011f\u0131m g\u00f6r\u00fc\u015fe var\u0131yorum. B\u00fct\u00fcn bunlar… Yani sava\u015f, kafirlerin boyunlar\u0131n\u0131n vurulmas\u0131, tutsakl\u0131k ba\u011flar\u0131n\u0131n s\u0131k\u0131 tutulmas\u0131 ve tutsaklar hakk\u0131ndaki \u015fu prensiplere uyulmas\u0131… B\u00fct\u00fcn bunlar “Sava\u015f sona erinceye kadard\u0131r.” <\/strong>Yani islam ile ona kar\u015f\u0131 gelen d\u00fc\u015fmanlar\u0131 aras\u0131nda sava\u015f bitinceye kadard\u0131r. \u0130\u015fte bu s\u00fcrekli ve her zaman ve yerde uygulanmak \u00fczere ge\u00e7erli bir prensiptir. \u00c7\u00fcnk\u00fc Resulullah’\u0131n dedi\u011fi gibi, “Cihad k\u0131yamet g\u00fcn\u00fcne kadar s\u00fcrecektir. Ki yery\u00fcz\u00fcnde Allah’\u0131n h\u00fckm\u00fc egemen olsun.” (Ebu Davut’un Hz. Enes’ten rivayet etmi\u015f oldu\u011fu hadi)<\/strong><\/p>\n

Y\u00fcce Allah, (ha\u015fa) m\u00fcsl\u00fcmanlara kafirlere kar\u015f\u0131 yard\u0131m dilemek i\u00e7in bu emirleri vermiyor, kendisini desteklesinler diye onlara cihad\u0131 farz k\u0131lm\u0131yor. \u00c7\u00fcnk\u00fc Allah Teala onlar\u0131 bizzat kendisi yok edebilir. Bu emirler Allah’\u0131n kullar\u0131n\u0131 birbiri ile denemesi ve bunun neticesi olarak da mertebelerini takdir etmesi ve belirlemesi i\u00e7indir. “Allah dileseydi onlardan ba\u015fka t\u00fcrl\u00fc de \u00f6c al\u0131rd\u0131. Bunun b\u00f6yle olmas\u0131 kiminizi kiminizle denemek i\u00e7indir. Allah kendi yolunda \u00f6lenlerin yapt\u0131klar\u0131n\u0131 bo\u015fa \u00e7\u0131karmaz.”<\/strong> ”<\/p>\n

“Allah onlar\u0131 hidayete iletecek ve durumlar\u0131n\u0131 d\u00fczeltecek.”<\/strong><\/p>\n

“Onlar\u0131, d\u00fcnyada iken tan\u0131tt\u0131\u011f\u0131 cennete koyar.”<\/strong><\/p>\n

Bu inkar edenler, Allah yolundan al\u0131koyanlar ve yery\u00fcz\u00fcnde her zaman bulunan azg\u0131n, zalim ve bozgunculuk eden benzerleri… Gurur ve g\u00fc\u00e7 elbisesi i\u00e7inde orta \u00e7\u0131kanlar… Kendilerini ve pe\u015flerinden giden sap\u0131klar\u0131 her\u015feyi yapabilen g\u00fc\u00e7l\u00fc kimseler olarak g\u00f6ren b\u00fct\u00fcn bu insanlar, Allah’\u0131n kullar\u0131 aras\u0131nda bir avu\u00e7 yarat\u0131k olmaktan \u00f6teye gidemezler.<\/p>\n

Evet b\u00fct\u00fcn bu insanlar, \u015fu yery\u00fcz\u00fc diye isimlendirilen k\u00fc\u00e7\u00fcc\u00fck yo\u011funlar tozmu\u015f bulutu \u00fcst\u00fcnde ya\u015fayan yarat\u0131klar aras\u0131nda bir avu\u00e7 olmaktan \u00f6teye ge\u00e7emezler \u00e7\u00fcnk\u00fc bu insanlar bunca y\u0131ld\u0131zlar\u0131n, gezegenlerin, nebulolar\u0131n, galaksilerin ve say\u0131lar\u0131 ile \u00e7aplar\u0131n\u0131 ancak Allah’\u0131n bildi\u011fi alemlerin aras\u0131nda yer alan bu k\u00fc\u00e7\u00fcc\u00fck, ad\u0131na d\u00fcnya denilen yerk\u00fcre \u00fczerinde ya\u015fayan yarat\u0131klar aras\u0131nda bir avu\u00e7 olmaktan \u00f6teye gidemezler. \u00dcstelik bu g\u00f6k cisimleri \u00f6yle bir uzaydad\u0131rlar ki, b\u00fct\u00fcn bu galaksiler ve alemler sanki uzay bo\u015flu\u011funda sa\u00e7\u0131lm\u0131\u015f noktac\u0131k gibi kal\u0131rlar. Nerde ise uzay\u0131n enginliklerinde kaybolup gitmi\u015flerdir. Bunlar\u0131 ancak orada bo\u015flukta Allah tutabilir, bir araya getirebilir ve d\u00fczene koyabilir.<\/p>\n

B\u00fct\u00fcn bu azg\u0131nlar ve arkalar\u0131na tak\u0131lan u\u015faklar, hatta \u015fu d\u00fcnyadaki t\u00fcm insanlar, Allah’\u0131n g\u00fcc\u00fc kar\u015f\u0131s\u0131nda k\u00fc\u00e7\u00fcc\u00fck birer kar\u0131nca olmaktan, \u00e7ok esintilerin kald\u0131rd\u0131\u011f\u0131 birer toz zerreleri olmaktan, hay\u0131r hay\u0131r asla hi\u00e7bir \u015fey olmaktan \u00f6teye ge\u00e7emezler.<\/p>\n

Y\u00fcce Allah m\u00fcminlere kafirlerin boyunlar\u0131n\u0131 vurmalar\u0131n\u0131, kendilerini yenip de iyice g\u00fc\u00e7s\u00fcz hale getirince ba\u011flar\u0131n\u0131 s\u0131k\u0131 tutmalar\u0131n\u0131 emrederken, onlar\u0131 kendi kudretine birer perde olarak kullanmaktad\u0131r. E\u011fer dileseydi kafirlerden a\u00e7\u0131ktan a\u00e7\u0131\u011fa intikam al\u0131rd\u0131. Nitekim baz\u0131lar\u0131ndan tufanla, baz\u0131lar\u0131ndan \u00e7\u0131\u011fl\u0131kla, baz\u0131lar\u0131ndan da yak\u0131c\u0131 r\u00fczgarla intikam alm\u0131\u015ft\u0131. Hatta hatta Allah kafirlerden isteseydi, b\u00fct\u00fcn bu sayd\u0131\u011f\u0131m\u0131z ara\u00e7lar\u0131 kullanmadan da intikam al\u0131rd\u0131. Fakat O, m\u00fcmin olan kullar\u0131 i\u00e7in hay\u0131r dilemekte, onlar\u0131 denemekte, e\u011fitimden ge\u00e7irmekte, durumlar\u0131n\u0131 d\u00fczeltmekte ve b\u00fcy\u00fck iyiliklere g\u00f6t\u00fcren yollar\u0131n kap\u0131s\u0131n\u0131 \u00f6nlerine a\u00e7maktad\u0131r.<\/p>\n

Allah onlar\u0131 denemek istemektedir. Bu denemede m\u00fcminlerin ruhlar\u0131nda en y\u00fcce enerjiler ve y\u00f6nelmeler harekete ge\u00e7iyor. \u00c7\u00fcnk\u00fc bir ruh i\u00e7in, onun inanm\u0131\u015f oldu\u011fu hakk\u0131n kendisine de\u011ferli olmas\u0131ndan daha y\u00fcce bir \u015fey d\u00fc\u015f\u00fcn\u00fclemez. Hak ruhta de\u011fer kazan\u0131nca o ki\u015fi hakk\u0131n yolunda hem \u00f6ld\u00fcr\u00fcr ve hem de \u00f6l\u00fcr. Hem kendisi ile ve hem de kendisi i\u00e7in ya\u015fad\u0131\u011f\u0131 bu hak u\u011fruna kimseye boyun e\u011fmez, onsuz bir hayata dayanamaz, onun g\u00f6lgesinden ba\u015fka bir yerde ge\u00e7ecek \u015fu hayat\u0131 sevemez.<\/p>\n

Ayr\u0131ca y\u00fcce Allah onlar\u0131 e\u011fitmek istiyor. Bunun sonucu kendisinden vazge\u00e7menin onlara a\u011f\u0131r geldi\u011fi \u015fu fani d\u00fcnyan\u0131n mal\u0131na istek ve hevesin t\u00fcm\u00fc g\u00f6n\u00fcllerinden \u00e7\u0131kar gider. Ve art\u0131k ruhlar\u0131ndaki her zay\u0131f olan \u015fey kuvvet kazanmaya, her t\u00fcrl\u00fc eksiklik tamam olmaya, her t\u00fcrl\u00fc hile ve ku\u015fku yok olmaya ba\u015flar. Art\u0131k en sonunda b\u00fct\u00fcn arzular\u0131 terazinin bir kefesinde, Allah’\u0131n cihad \u00e7a\u011fr\u0131s\u0131 onun zat\u0131n\u0131 ve ho\u015fnutlu\u011funu arzulama ise di\u011fer kefesinde yer al\u0131r. O da \u00e7a\u011fr\u0131s\u0131n\u0131 ve ho\u015fnutlu\u011funu al\u0131r ve \u00f6tekileri kald\u0131r\u0131r atar. Ve y\u00fcce Allah bilir ki bu g\u00f6n\u00fcller iki se\u00e7enekten birisi ile serbest b\u0131rak\u0131lm\u0131\u015flar da Allah’\u0131n ho\u015fnutlu\u011funu se\u00e7mi\u015flerdir. Bu ruhlar e\u011fitilmi\u015fler ve bilmi\u015flerdir. Bu ruhlar bilin\u00e7sizce \u00f6ne at\u0131lmam\u0131\u015flar fakat \u00f6l\u00e7\u00fcp bi\u00e7mi\u015fler sonra da se\u00e7imlerini yapm\u0131\u015flard\u0131r.<\/p>\n

Allah onlar\u0131n durumlar\u0131n\u0131 d\u00fczeltmek istiyor. Allah yolunda cihad \u00e7ilesi, her at\u0131l\u0131\u015fta \u00f6l\u00fcmle burun buruna gelmek insan\u0131n g\u00f6nl\u00fcne bu korkun\u00e7 tehlikeyi k\u00fc\u00e7\u00fcmseme duygusu veriyor. Bu \u00f6yle bir tehlikedir ki, insanlar\u0131n \u00e7o\u011fu ondan korunmak i\u00e7in vicdanlar\u0131ndan, ahl\u00e2klar\u0131ndan, \u00f6l\u00e7\u00fclerinden ve de\u011ferlerinden neleri feda etmezler! Bu tehlike ile y\u00fczy\u00fcze gelmeye al\u0131\u015fanlara bu tehlike -ister ondan kurtulsunlar ister \u00f6ls\u00fcnler- son derece basittir. Her defa Allah i\u00e7in cihada y\u00f6nelmek ruhlarda tehlike anlar\u0131ndakine benzer etkiler yapar. Elektri\u011fin v\u00fccuda yapt\u0131\u011f\u0131 etki bunu anlamaya yard\u0131mc\u0131 olan en yak\u0131n \u00f6rnektir. Sanki cihad kalpleri ve ruhlar\u0131 safl\u0131k, duruluk ve d\u00fczg\u00fcnl\u00fck hamuru ile yeniden yo\u011furur.<\/p>\n

Sonra b\u00fct\u00fcn bunlar t\u00fcm insan topluluklar\u0131n\u0131 m\u00fccahidlerin elleri ile kumanda ederek d\u00fczeltmek i\u00e7in g\u00f6zle g\u00f6r\u00fclen d\u0131\u015f nedenlerdir. Bu m\u00fccahidler d\u00fcnyan\u0131n fani olan t\u00fcm mallar\u0131ndan ve s\u00fcslerinden vazge\u00e7mi\u015flerdir. Allah yolunda \u00f6l\u00fcm\u00fcn kuca\u011f\u0131na at\u0131l\u0131rlarken d\u00fcnya hayat\u0131 g\u00f6zlerinde de\u011fersiz kalm\u0131\u015ft\u0131r. Art\u0131k g\u00f6n\u00fcllerinde kendilerini Allah’tan ve O’nun ho\u015fnutlu\u011funu arzulamaktan al\u0131koyacak hi\u00e7bir \u015fey kalmam\u0131\u015ft\u0131r. \u0130ktidar bu gibi ellere ge\u00e7erse yery\u00fcz\u00fc bir u\u00e7tan bir uca d\u00fczeldi\u011fi gibi kullar da d\u00fczelir.
