Hamd kendisinden ba\u015fka ilah olmayan, mutlak manada tek g\u00fc\u00e7 ve kudret sahibi olan Allah(Celle Celaluhu)\u2019a mahsustur. Salat ve selam t\u00fcm peygamberlerin ve onlar\u0131 takip eden tabilerinin \u00fczerine olsun.<\/strong><\/p>\n

236-<\/strong> Kad\u0131nlara yakla\u015fmadan veya onlara mehir takdir etmeden bo\u015farsan\u0131z, sizin i\u00e7in bir mesuliyet yoktur. Bu durumda zengin kendi imk\u00e2n\u0131na g\u00f6re fakir de kendi imk\u00e2n\u0131na g\u00f6re, usul\u00fcne uygun bir \u015fekilde on\u00adlara, faydalanacaklar\u0131 bir \u015feyler verin. Bu, iyilikle bulunanlar\u0131n \u00fczerine bir bor\u00e7tur.<\/p>\n

Ey iman edenler, evlendi\u011finiz ve kendilerine mehir takdir etti\u011finiz kad\u0131n\u00adlar\u0131, kendilerine dokunmadan \u00f6nce bo\u015faman\u0131zda bir g\u00fcnah yoktur. Yine sizlerin, kendileriyle evlendi\u011finiz, kendilerine mehir takdir etmedi\u011finiz ve kendilerine dokunmad\u0131\u011f\u0131n\u0131z kad\u0131nlar\u0131 bo\u015faman\u0131zda sizin i\u00e7in bir g\u00fcnah yoktur. Kad\u0131nlar\u0131 bo\u015faman\u0131z halinde onlara, “Mut’a” diye adland\u0131r\u0131lan bir k\u0131s\u0131m \u015feyler veriniz. Bu e\u015fyalar zenginin kendi haline g\u00f6re fakirinde Rendi haline g\u00f6re takdir edilir. Bu e\u015fyalar Allan\u0131n size emretii\u011fi ve\u00e7hile verilir. Bunlar, iyilikte bulunanlar \u00fczerine gerekli olan bir bor\u00e7tur.<\/p>\n

Taberiye g\u00f6re bu \u00e2yetin ba\u015f taraf\u0131nda, evlendikten sonra kemlilerine ‘dokunulmayan ve bu haliyle bo\u015fanan iki s\u0131n\u0131f kad\u0131n zikredilmi\u015ftir.<\/p>\n

Bunlardan biri, evlenildikten sonra kendilerine dokunulmayan ve evlenir\u00adken kendilerine mehir takdir edilen kad\u0131nlard\u0131r. Ki\u015fi b\u00f6yle bir kad\u0131n\u0131 ho\u015fafl\u0131\u011f\u0131n\u00adda; bundan sonra gelen \u00e2yette de zikredikli\u011fi gibi, ona takdir edilen n\u0131ehirin ya\u00adr\u0131s\u0131n\u0131 ve\u0131mek zorundad\u0131r.<\/p>\n

Di\u011feri ise, evlenildikten sonra kendilerine dokunulmayan ve mehir dciak-dir edilmeyen kad\u0131nlard\u0131r. Ki\u015fi b\u00f6yle bir evlilik yapar ve kad\u0131na dokunmadan bo\u015fayacak olursa bu kad\u0131n\u0131n mehiri zikredilmedi\u011finden ona”Mut’a*1 diye adlan\u00add\u0131r\u0131lan bir k\u0131s\u0131m e\u015fyalar verilir.<\/p>\n

\u00c2yet-i kerimede ge\u00e7en ve “Faydalanacaklar\u0131 \u015feyler verin.” diye terc\u00fcme edilen kelimesinden anla\u015f\u0131lan “MutV’dan neyin kastedildi\u011fi hususun\u00adda m\u00fcfessirler farkl\u0131 g\u00f6r\u00fc\u015fler zikretmi\u015flerdir:<\/p>\n

a-<\/strong> Baz\u0131lar\u0131na g\u00f6rer erke\u011fin, bo\u015fad\u0131\u011f\u0131 kad\u0131na vermesi eredilen “E\u015fya”dan maksat, en fazla bir k\u00f6le, orta olan\u0131 para en az\u0131 ise elbisedir. Elbisenin ise bir ba\u015f\u00f6rt\u00fcs\u00fc, bir v\u00fccudun \u00fcst k\u0131sm\u0131na giyilen bir elbise ve v\u00fccudun alt k\u0131sm\u0131na gi\u00adyilen elbise bir de \u00e7ar\u015faft\u0131r. Kad\u0131 \u015e\u00fcreyh bu “MutY’y\u0131 be\u015f y\u00fcz dirhem olarak takdir etmi\u015ftir. \u0130bn-i \u015e\u00eer\u00een, mut’anm bir k\u00f6le veya nafaka yahut elbise olaca\u011f\u0131n\u0131 a\u00e7\u0131klam\u0131\u015f ve Hz. Alinin o\u011flu Hasan\u0131n, bo\u015fad\u0131\u011f\u0131 kad\u0131na on bin dirhem verdi\u011fini s\u00f6ylemi\u015ftir.<\/p>\n

b-<\/strong> Di\u011fer b ir k\u0131s\u0131m \u00e2limler ise mut’an\u0131n, bo\u015fanan kad\u0131n\u0131n benzeri olan ka\u00add\u0131nlara verilen mehirin yans\u0131 kadar olaca\u011f\u0131n\u0131 s\u00f6ylemi\u015flerdir. Zira mehiri belli olan kad\u0131nlar dokunulmadan bo\u015fanacak olurlarsa onlara mehirlerini\u0131i yar\u0131s\u0131 veri\u00adlir. Mehilleri tesbit edilmemi\u015fse onlara da “Mut’a” denen \u015feyler verilir. Bu \u015fey\u00adlerin de, kendisine mehir tesbit edilen kad\u0131n\u0131n mehirinin yar\u0131s\u0131 kadar de\u011ferde ol\u00admas\u0131 hakkaniyete daha uygundur,<\/p>\n

Taberi, \u00e2yet-i kerimede: “Zengin kendi imk\u00e2n\u0131na gorc, fakir de kendi imk\u00e2n\u0131na g\u00f6re” buyurulmas\u0131n\u0131 g\u00f6z\u00f6n\u00fcnde bulundurarak “Mut’a” denen e\u015fya\u00adn\u0131n, kad\u0131n\u0131n mehiri g\u00f6z\u00f6n\u00fcnde bulundurularak takdir edilemeyece\u011fini, erke\u011fin<\/p>\n

M\u00fcfessirler: “Faydalanacaklar\u0131 bir \u015feyler verin.” diye terc\u00fcme edilen emrinin farziyet mi yoksa mendubiyet mi ifade etti\u011fi hususunda farkl\u0131 g\u00f6r\u00fc\u015fler zikretmi\u015flerdir. Baz\u0131lar\u0131na g\u00f6re bu emir farziyet ifade etmektedir. Kar\u0131\u00ads\u0131n\u0131 bo\u015fayan erke\u011fin ona bir k\u0131s\u0131m e\u015fyalar vermesi farzd\u0131r. Di\u011fer baz\u0131lar\u0131na g\u00f6re ise kar\u0131s\u0131n\u0131 bo\u015fayan erkek ona bir k\u0131s\u0131m e\u015fya verip vermemekte serbesttir. An\u00adcak vermesi daha evlad\u0131r. Bu g\u00f6r\u00fc\u015fleri \u015fu \u015fekilde \u00f6zetlemek m\u00fcmk\u00fcnd\u00fcr.<\/p>\n

C\u00fcbeyre g\u00f6re erkek kar\u0131s\u0131n\u0131 hangi halde bo\u015farsa bo\u015fas\u0131n onun, bo\u015fadi\u011f\u0131 kar\u0131s\u0131na “Mut’a” diye adland\u0131r\u0131lan bir k\u0131\u00ads\u0131m e\u015fyalar vermesi onun \u00fczerine farzd\u0131r. Bu hususta Hasan-\u0131 Basri’den, kendi\u00adsine mehir takdir edilen ve dokunulmadan bo\u015fanan kad\u0131na “Mut’a” denen e\u015fya verilecek midir? diye sorulunca o da: “Evet vallahi” demi\u015ftir. G\u00f6r\u00fcld\u00fc\u011f\u00fc gibi bunlara g\u00f6re evi eni lirken kendisine mehir takdir edilen ve kendisine dokunul\u00admadan bo\u015fanan kad\u0131na dahi mehirin yans\u0131 verildi\u011fi gibi “Mut’a” denen di\u011fer bir k\u0131s\u0131m e\u015fya da verilir.<\/p>\n

b-<\/strong> Abdullah b. \u00d6mer, Said b. el-M\u00fcseyyeb, M\u00fccahid, N\u00e2fi, \u0130bn-i Ebu Neciyh ve Kad\u0131 \u015e\u00fcreyhten nakledilen di\u011fer bir g\u00f6r\u00fc\u015fe g\u00f6re bu \u00e2yette zikredilen ve “Mut’a” diye adland\u0131r\u0131lan e\u015fya, kendisine mehir takdir edilmeden evlenilen ve kendisine dokunulmadan bo\u015fanan kad\u0131nlar i\u00e7in farzd\u0131r. B\u00f6yle bir evlilik ya\u00adp\u0131p sonra da kar\u0131s\u0131n\u0131 bo\u015fayan bir erke\u011fin, kar\u0131s\u0131na “Mut’a” diye adland\u0131r\u0131lan e\u015f\u00adyay\u0131 vermesi, \u00fczerine farzd\u0131r. Ka\u00eeade bu hususta Said b. el-M\u00fcseyyebin \u015funlar\u0131 s\u00f6yledi\u011fini rivayet etmi\u015ftir. “Ahzab suresinin \u015fu \u00e2yet-i kerimesinde, kendisine dokunulmadan bo\u015fanan her kad\u0131n i\u00e7in \u015f\u00f6yle Duyurulmu\u015ftur: “Ey iman edenler, m\u00fcmin kad\u0131nlar\u0131 nikahlar sonra da kendilerine dokunmadan bo\u015farsan\u0131z art\u0131k sizin, onlar\u0131n \u00fczerinde iddet sayma hakk\u0131n\u0131z yoktur. Derhal onlara bo\u015fama bedellerini verin ve onlar\u0131 g\u00fczellikle sal\u0131verin. Daha sonra ise \u015fu \u00e2yet-i kerime nazil oldu ve kendilerine dokunulmadan bo\u015fanan kad\u0131nlardan mehir takdir edilenlere mehirlerinin yar\u0131s\u0131n\u0131n verilece\u011fi emredildi. Ahzab s\u00fcre\u00adsindeki \u00e2yeti nesneden Bakara s\u00fcresindeki \u00e2yet \u015fudur: “E\u011fer kad\u0131nlara mehir (akdir etti\u011finiz halde onlara dokunmadan bo\u015farsan\u0131z tayin etti\u011finiz mehi\u00adrin yar\u0131s\u0131n\u0131 onlara verin.<\/p>\n

c-<\/strong> Z\u00fchriden rivayet edilen ba\u015fka bir g\u00f6r\u00fc\u015fe g\u00f6re bu \u00e2yette zikredilen ve “Mut’a” diye adland\u0131r\u0131lan e\u015fya, bo\u015fanan her kad\u0131n\u0131n hakk\u0131d\u0131r. Ancak bu hak, bo\u00ad\u015fanan kad\u0131nlardan baz\u0131lar\u0131 i\u00e7in mahkeme karar\u0131yla teminat alt\u0131na al\u0131nan haklar dand\u0131r. Yani kendisine mehir takdir edilmeden evlenilen ve kendisine dokunulmadan bo\u015fan\u0131lan kad\u0131n i\u00e7in mut’a alma bir hakt\u0131r. Bo\u015fayan koca bunu vermedi\u011fi takdir\u00adde kad\u0131n mahkeme karar\u0131yla bu hakk\u0131n\u0131 al\u0131r. Zira b\u00f6yle bir kad\u0131n\u0131n mehiri hi\u00e7 zikredilmedi\u011finden kocan\u0131n ondan herhangi bir \u015fey almaya (mehrin yar\u0131s\u0131n\u0131 vermemek gibi) hakk\u0131 yoktur. Buna mukabil kendisine mehir takdir edilen ka\u00add\u0131n, gerek zifaftan \u00f6nce gerekse sonra bo\u015fand\u0131\u011f\u0131 takdirde bunun da “Mut’a” diye adland\u0131r\u0131lan baz\u0131 \u015feyler alma hakk\u0131d\u0131r. Ancak kocas\u0131 bunu vermezse kad\u0131n her\u00adhangi bir mercie ba\u015f vurarak bu hakk\u0131n\u0131 alma imk\u00e2n\u0131na sahip de\u011fildir. Bu izaha g\u00f6re bu \u00e2yette zikredilen “Mut’a”dan maksat, hakim karar\u0131yla teminat alt\u0131na al\u0131\u00adnan e\u015fyad\u0131r. Bu surenin y\u00fcz k\u0131rk birinci \u00e2yetinde zikredilen “MutY’dan maksat ise hakim karar\u0131yla teminat alt\u0131na al\u0131namayan sadece takva sahiplerinin insiyati-f\u0131nde kalan bir mut’ad\u0131r.<\/p>\n

d- Kad\u0131 \u015e\u00fcreyhden rivayet edilen ba\u015fka bir g\u00f6r\u00fc\u015fe g\u00f6re bo\u015fanan kad\u0131na mut’a, yani bir k\u0131s\u0131m e\u015fya vermek farz de\u011fildir. Kad\u0131n ne suretle bo\u015fan\u0131rsa bo-\u015fans\u0131n bu gibi e\u015fyay\u0131 kocas\u0131ndan hakim karar\u0131yla alma hakk\u0131na sahip de\u011fildir. Bu gibi e\u015fyay\u0131 vermek koca i\u00e7in menduptur. Zira mut’a verilmesini beyan eden ayetlerden birincisinin sonunda “Bu, iyilikte bulunanlar\u0131n \u00fczerinde bir hakt\u0131r.” Duyurulmakta di\u011ferinin sonunda ise “Bu, takva sahipleri \u00fczerinde bir hakt\u0131r.” Duyurulmaktad\u0131r \u015eayet mut’a verme mendup olmay\u0131p farz olsayd\u0131 b\u00fct\u00fcn in\u00adsanlar\u0131n \u00fczerinde bir hak oldu\u011fu zikredilirdi. Sadece iyilikte bulunanlar\u0131n ve takva sahiplerinin \u00fczerinde bulunan bir hakt\u0131r.” \u015feklinde zikredilmezdi.<\/p>\n

Taberi diyor ki: “Tercih edilen g\u00f6r\u00fc\u015f \u015fudur ki: Mut’a denen e\u015fya, bo\u015fanan her kad\u0131n i\u00e7in bir hakt\u0131r. Bo\u015fayan kocan\u0131n bu hakk\u0131 yerine getim\u0131esi bir vecibe\u00addir. Taberi bu g\u00f6r\u00fc\u015f\u00fc tercih edi\u015finin gerek\u00e7esi olarak mut’a vermeyi emreden \u00e2yet-i kerimenin mutlak bir \u015fekilde zikredilmi\u015f olmas\u0131n\u0131 g\u00f6stermi\u015ftir. Mutlak olarak zikredilen bir \u00e2yeti, delilsiz olarak \u00f6zel bir \u015fekilde yorumlamaya kimse\u00adnin hakk\u0131 olmad\u0131\u011f\u0131n\u0131 beyan etmi\u015ftir. Taberi diyor ki: E\u011fer denilecek olursa ki “Sen \u00e2yetin umum ifade etti\u011fini s\u00f6yl\u00fcyorsun halbuki Allah teala, kendilerine mehir takdir ediierek, dokunulmadan bo\u015fan\u0131lan kad\u0131nlara mehirlerinin yar\u0131s\u0131n\u0131n verilece\u011fini beyan etmi\u015f, bunlara daha ba\u015fka \u015feyler verilece\u011fini zikretmemi\u015ftir. Bu da g\u00f6steriyor ki mut’a vermeyi emreden \u00e2yet, umumi m\u00e2n\u00e2 ifade etmemek\u00adtedir. Sadece belli bir durumda bo\u015fanan kad\u0131nlar i\u00e7in ge\u00e7erlidir.” Cevaben deni\u00adlir ki: “Allah teala, kitab\u0131n\u0131n herhangi bir yerinde belli bir \u015feyin farz oldu\u011funu belirtirse art\u0131k her yerde ayn\u0131 \u015feyi tekrar etmesi gerekli de\u011fildir. Allah teala \u015fu \u00e2yette, her bo\u015fanan kad\u0131na, mut’a diye adland\u0131r\u0131lan e\u015fyan\u0131n verilece\u011fini beyan etmi\u015f ve buyurmu\u015ftur ki: “Bo\u015fanan kad\u0131nlar\u0131n \u00f6rfe g\u00f6re faydalanacaklar\u0131 bir k\u0131\u00ads\u0131m e\u015fyalar (mut’a) alma haklar\u0131 vard\u0131r. Bu, takva sahipleri \u00fczerine bir bor\u00e7tur.<\/p>\n

Aiiah teala bu \u00e2yetinde, herhangi bir ay\u0131r\u0131m yapmaks\u0131z\u0131n, bo\u015fanan ka\u00add\u0131nlara mut1 a vermenin bir hak oklu\u011funu beyan etti\u011fine g\u00f6re, kendilerine doku\u00adnulmadan bo\u015fanan kad\u0131nlar\u0131n mehillerinin yans\u0131n\u0131 almalar\u0131ndan sonra art\u0131k mut’a almaya haklar\u0131n\u0131n olmad\u0131\u011f\u0131m s\u00f6ylemek, delilsiz b ir iddiad\u0131r. Zira b\u00f6yle bir kad\u0131n\u0131n, hem mehirin yans\u0131n\u0131 hem de mut’a diye adland\u0131r\u0131lan e\u015fyay\u0131 birlikte almay\u0131 hak etti\u011fini s\u00f6ylemeye engel nedir? Taberi diyor ki: “Kanaatim k\u0131saca \u015fudur ki: “Bo\u015fanan her kad\u0131n\u0131n, mut’a diye adland\u0131r\u0131lan bir k\u0131s\u0131m e\u015fyalar almas\u0131, onun, kendisini bo\u015fayan kocas\u0131n\u0131n \u00fczerinde bulunan bir hakk\u0131d\u0131r. Koca, kar\u0131s\u0131n\u0131n mehirini verme hususunda huku\u00adken hesaba \u00e7ekilece\u011fi gibi bu e\u015fyay\u0131 verme hususunda da hesaba \u00e7ekilir. Koca\u00adn\u0131n b\u00f6yle bir bor\u00e7lan kurtulmas\u0131 ya bunu \u00f6demesiyle veya kar\u0131s\u0131n\u0131n ona bunu ba\u011fi\u015flamas\u0131yla m\u00fcmk\u00fcnd\u00fcr. Bunu vermekten imtina eden kocan\u0131n, sat\u0131larak borcu \u00f6denecek mah yoksa hapsedilece\u011fi kanaatindeyim. Zira Allah teala izah etti\u011fimiz bu \u00e2yet-i kerimede c\u00fcmlesiyle “Onlara met’a verin” diye emretmektedir. Allah tealan\u0131n kay\u0131ts\u0131z \u015farts\u0131z emirleri ise, memlup olduklar\u0131 yi\u00adne bizzat kendisi taraf\u0131ndan bildirilmedi\u011fi takdirde farziyet ifade eder. Di\u011feryandan “Bo\u015fanan kad\u0131nlar\u0131n \u00d6rfe g\u00f6re faydalanacaklar\u0131 bir k\u0131s\u0131m e\u015fyalar alma haklan vard\u0131r. \u00e2yet-i kerimesi, b\u00fct\u00fcn m\u00fcfcssirlerin g\u00f6r\u00fc\u015f birli\u011fi ile “Koca\u00adlar \u00fczerindeki-hakt\u0131r” anlam\u0131na gelmektedir. Durum b\u00f6yle oldu\u011funa g\u00f6re koca\u00adn\u0131n, bu bor\u00e7lar\u0131ndan kurtulmas\u0131 i\u00e7in yukar\u0131da zikredilen \u00f6deme veya borcunun ba\u011f\u0131\u015flanmas\u0131 \u015f\u0131klar\u0131ndan birine haiz olmas\u0131 gerekir. \u015eayet, kafas\u0131 \u00e7al\u0131\u015fmayan bi\u00adrisi diyecek olursa ki “Allah te\u00e2la mut’a diye adland\u0131r\u0131lan e\u015fyan\u0131n verilmesini beyan etti\u011fi \u00e2yetlerin sonunda “Bunu vermek, iyilikte bulunanlar\u0131n \u00fczerine bir bor\u00e7tur. Bunu vermek, takva sahiplerinin \u00fczerine bir bor\u00e7tur. buyurarak, bu bor\u00e7lar\u0131n farz olmad\u0131\u011f\u0131n\u0131 ifade etmi\u015ftir! Zira bu bor\u00e7lar farz olsayd\u0131, sadece iyilikte bulunanlara ve takva sahiplerine de\u011fil b\u00fct\u00fcn insanlar\u0131n \u00fczerine bor\u00e7 ol\u00addu\u011fu beyan edilirdi.” Cevaben denilir ki: “\u0130nsanlar\u0131, iyilikte bulunmak ve takva sahibi olmakla s\u0131fatland\u0131rmak, bu gibi s\u0131fatlara sahip olan insanlar\u0131n y\u00fck\u00fcml\u00fc olduklar\u0131 vazifelerle di\u011fer insanla\u0131nn y\u00fck\u00fcml\u00fc olmad\u0131klar\u0131 anlam\u0131na gelmez. Zira Allah teala b\u00fct\u00fcn insanlar\u0131n, iyilikte bulunanlardan ve takva sahibi olanlar\u00addan olmalar\u0131n\u0131 istemektedir. O halde iyilikte bulunanlara ve di\u011fer lakva sahiple\u00adrine farz k\u0131ld\u0131\u011f\u0131 \u015feyler, di\u011fer insanlar i\u00e7in de farzd\u0131r.<\/p>\n

Taberi s\u00f6zlerine devamla diyor ki: “B\u00fct\u00fcn m\u00fcfessirlere g\u00f6re evlenme s\u0131\u00adras\u0131nda kendisine mehir tayin edilmeyen ve kendisine dokunulmadan bo\u015fan\u0131lan kad\u0131nlar i\u00e7in “Mut’a” diye adland\u0131r\u0131lan e\u015fyan\u0131n verilmesi farzd\u0131r. Zira bunlar, mehirden herhangi bir \u015fey almaya haklan olmad\u0131\u011f\u0131 i\u00e7in onun yerine “Mut’a” diye adland\u0131r\u0131lan e\u015fyay\u0131 al\u0131rlar. Nitekim Abdullah b. Abbas, Hasnn-\u0131 Basri, Nafi, M\u00fccahid, S\u00fcddi, Katade ve Dehhuk, kendisine mehir takdir edilmeyen ve ken\u00addisine dokunulmadan bo\u015fanan kad\u0131n\u0131n mut’a dan ba\u015fka bir \u015fey alamayaca\u011f\u0131 hu\u00adsusunu zikretmi\u015flerdir.<\/p>\n

Taberi diyor ki: “E\u011fer denilecek olursa ki “\u00c2yet-i kerimede “Kad\u0131nlara yakla\u015fmadan bo\u015farsan\u0131z sizin i\u00e7in bir mes’uliyet yoktur.” buyurul\u0131naktad\u0131r. \u015ea\u00adyet kad\u0131nlara yakla\u015ft\u0131ktan sonra onlar\u0131 bo\u015fayacak olursak bizim i\u00e7in bir mes’uli\u00adyet mi vard\u0131r?” Cevaben denilir ki: “S\u0131rf kad\u0131nlardan zevk almak i\u00e7in evlenip sonra da bo\u015famak do\u011fru bir davran\u0131\u015f de\u011fildir. Bu hususta Resulullahin: “\u015e\u00fcphesiz ki Allah, s\u0131rf zevkini tatmin i\u00e7in evlenen erkekleri, yine s\u0131rf zevkini tatmin etmek i\u00e7in evlenen kad\u0131nlar\u0131 sevmez.” buyurdu\u011fu rivayet edilmekte\u00addir.
