Hamd kendisinden ba\u015fka ilah olmayan, mutlak manada tek g\u00fc\u00e7 ve kudret sahibi olan Allah\u2019a mahsustur. Salat ve selam t\u00fcm peygamberlerin ve onlar\u0131 takip eden tabilerinin \u00fczerine olsun.<\/p>\n

20- Bir e\u015fi b\u0131rak\u0131p yerine bir ba\u015fka e\u015fi almak isterseniz, onlardan birine (\u00f6ncekine) y\u00fcklerle (mal ve para) vermi\u015fseniz bile ondan hi\u00e7 bir \u015fey almay\u0131n. Ona iftira ederek ve apa\u00e7\u0131k bir g\u00fcnaha girerek verdi\u011finizi alacak m\u0131s\u0131n\u0131z?<\/strong>
\n21- Onu nas\u0131l al\u0131rs\u0131n\u0131z ki, birbirinize kat\u0131lm\u0131\u015f (birle\u015ferek i\u00e7li-d\u0131\u015fl\u0131 olmu\u015f) t\u0131n\u0131z. Onlar sizden kesin bir g\u00fcvence (kuvvetli bir ahid) de alm\u0131\u015flard\u0131.(31)<\/strong>

A\u00c7IKLAMA<\/strong><\/p>\n

31.<\/strong> “Sa\u011flam teminat”; bir kad\u0131n\u0131n, kendisini kocas\u0131na teslim etmesini sa\u011flayan evlilik ba\u011f\u0131n\u0131n garantisidir. Bu nedenle e\u011fer erkek, kendi verdi\u011fi teminat\u0131 hi\u00e7e sayarsa, anla\u015fman\u0131n (evlili\u011fin) meydana geldi\u011fi zaman, kar\u0131s\u0131na verdi\u011fi mehirden istemeye hakk\u0131 olmaz. (Bkz. Bakara an: 251) .
\n32.<\/strong> Kur’an cahiye d\u00f6neminde i\u015flenen k\u00f6t\u00fcl\u00fckleri yasaklarken, genellikle emri \u015fu kelimelerle bitirir. Ge\u00e7mi\u015fte olanlar hari\u00e7. Bunun g\u00f6r\u00fcn\u00fcrde iki anlam\u0131 vard\u0131r: Birincisi, ki\u015fi e\u011fer bu emri ald\u0131ktan sonra, o yoldan d\u00f6ner ve hatalar\u0131n\u0131 tamir ederse, ge\u00e7mi\u015fte i\u015flenen hatalar\u0131n dikkate al\u0131nmayaca\u011f\u0131 anlat\u0131lmak isteniyor. \u0130kincisi, bu emirlerin ge\u00e7mi\u015fte olanlarla bir ilgisi olmad\u0131\u011f\u0131n\u0131 belirterek, bu hatalar\u0131 i\u015fleyenler teselli ediliyor. S\u00f6z gelimi, e\u011fer bir kimse yasaklanmadan \u00f6nce \u00fcvey annesi ile evlenmi\u015fse, bu s\u00f6zlere g\u00f6re, bu evlilikten olma \u00e7ocuklar\u0131n otomatikman gayri me\u015fru olmalar\u0131 ve mirastan mahrum b\u0131rak\u0131lmalar\u0131 s\u00f6z konusu de\u011fildir.
\nYine s\u00f6zgelimi, bir kimse sonradan yasaklanan bir ticaret \u015fekliyle bir\u00e7ok al\u0131\u015fveri\u015fler yapm\u0131\u015f olsa, bu daha \u00f6nce yap\u0131lan b\u00fct\u00fcn anla\u015fmalar\u0131n ge\u00e7ersiz oldu\u011fu, ki\u015finin bu yolla kazand\u0131\u011f\u0131 b\u00fct\u00fcn servetini geri vermesi gerekti\u011fi veya o zamana dek kazan\u0131lan mallar\u0131n hepsinin haram oldu\u011fu anlam\u0131na gelmez.
\n33.<\/strong> \u0130sl\u00e2m hukukuna g\u00f6re bu, cezay\u0131 gerektiren bir davran\u0131\u015ft\u0131r. Ebu Davut, Nese\u00ee ve M\u00fcsned-i Ahmed’de nakledilen baz\u0131 hadislere g\u00f6re, Hz. Peygamber (s.a) \u00fcvey anneleriyle evlenen ki\u015filerin, mallar\u0131na el koymu\u015f ve onlar\u0131 \u00f6l\u00fcm cezas\u0131na \u00e7arpt\u0131rm\u0131\u015ft\u0131r. \u0130bn Mace’de, Hz. \u0130bn Abbas’tan rivayet edilen bir hadise g\u00f6re Hz. Peygamber (s.a) bu konuda \u015fu h\u00fckm\u00fc vermi\u015ftir: “Evlenmenin yasakland\u0131\u011f\u0131 ki\u015filerle zina eden herkes \u00f6l\u00fcm cezas\u0131na \u00e7arpt\u0131r\u0131l\u0131r.” Bununla birlikte \u0130sl\u00e2m f\u0131k\u0131h alimlerinin bu konuda farkl\u0131 g\u00f6r\u00fc\u015fleri vard\u0131r. \u0130mam Ahmed, b\u00f6yle bir su\u00e7lunun mal\u0131na el konulmas\u0131 ve \u00f6l\u00fcm cezas\u0131na \u00e7arpt\u0131r\u0131lmas\u0131 gerekti\u011fini savunur. Ebu Hanife, \u0130mam Malik ve \u0130mam \u015eafii ise, haram olan ki\u015filerle zina eden bir kimsenin normal zina cezas\u0131na \u00e7arpt\u0131r\u0131lmas\u0131, haram olan ki\u015filerden biri ile evlendi\u011finde ise, bu b\u00fcy\u00fck g\u00fcnah i\u00e7in uygun olacak bir cezaya \u00e7arpt\u0131r\u0131lmas\u0131 gerekti\u011fi g\u00f6r\u00fc\u015f\u00fcndedirler.
\n34.<\/strong> Bu yasak; hem \u00f6z, hem de \u00fcvey anne i\u00e7in ge\u00e7erlidir ve ikisi de haramd\u0131r. Bu kural ayn\u0131 zamanda annenin annesi ve baban\u0131n annesi i\u00e7in de ge\u00e7erlidir. Babas\u0131n\u0131n gayri me\u015fru ili\u015fkide bulundu\u011fu bir kad\u0131n\u0131n, o\u011fula haram olup olmad\u0131\u011f\u0131 konusunda alimler farkl\u0131 g\u00f6r\u00fc\u015flere sahiptirler. B\u00f6yle bir kad\u0131nla evlenmenin haram oldu\u011fu g\u00f6r\u00fc\u015f\u00fcnde olanlar, baban\u0131n \u015fehvetle dokundu\u011fu bir kad\u0131n\u0131n bile, o\u011fula haram oldu\u011funu s\u00f6ylerler. O\u011fulun gayri me\u015fru ili\u015fkide bulundu\u011fu bir kad\u0131n\u0131n babaya haram olup olmad\u0131\u011f\u0131 veya k\u0131z\u0131n gayri me\u015fru ili\u015fkide bulundu\u011fu bir adam\u0131n anneye veya tam tersi bir durumun, k\u0131za haram olup olmad\u0131\u011f\u0131 konusunda da bir \u00e7ok ihtil\u00e2flar vard\u0131r. Bu meselenin f\u0131kh\u00ee incelikleriyle ilgili bir\u00e7ok kar\u015f\u0131t g\u00f6r\u00fc\u015f vard\u0131r. Fakat biraz d\u00fc\u015f\u00fcn\u00fcl\u00fcnce, bu t\u00fcr olaylar\u0131n toplum hayat\u0131nda meydana gelmemesi gerekti\u011fi ve hak yolundaki bir hayatla uyum i\u00e7inde olmad\u0131\u011f\u0131 anla\u015f\u0131l\u0131r. Bu nedenle il\u00e2h\u00ee kanun; bu t\u00fcr \u015feyleri k\u0131l\u0131 k\u0131rk yararak hel\u00e2l k\u0131lmaya \u00e7al\u0131\u015f\u0131lmas\u0131na m\u00fcsamaha g\u00f6steremez. \u00c7\u00fcnk\u00fc bu k\u00fc\u00e7\u00fcc\u00fck ayr\u0131l\u0131klar, t\u00fcm toplum refah\u0131n\u0131n dayana\u011f\u0131 olan aile ba\u011f\u0131n\u0131n kopmas\u0131na neden olacak k\u0131skan\u00e7l\u0131klar a\u00e7\u0131\u011fa \u00e7\u0131karacakt\u0131r. Bu, a\u015fa\u011f\u0131da yer alan, Hz. Peygamber’in (s.a) iki hadisi ile de desteklenmektedir:
\n1) “Bir erke\u011fe, cinsel organ\u0131na bakt\u0131\u011f\u0131 bir kad\u0131n\u0131n annesi ve k\u0131z\u0131 haram olur.”
\n2) “Allah, ayn\u0131 zamanda hem annenin hem de k\u0131z\u0131n cinsel organ\u0131n\u0131 g\u00f6ren bir adama bakmaktan bile ho\u015flanmaz.”
\n35.<\/strong> K\u0131z i\u00e7in s\u00f6ylenen haram h\u00fckm\u00fc, o\u011fulun k\u0131z\u0131 ve k\u0131z\u0131n k\u0131z\u0131 (yani torunlar) i\u00e7in de ge\u00e7erlidir. E\u011fer s\u00fctten kesildikten sonra emerse, haram olmaz, \u00e7\u00fcnk\u00fc bu aynen su i\u00e7mek gibidir. Hz. Ali’nin (r.a) de bunu destekleyen bir s\u00f6z\u00fc vard\u0131r.
\n2) Hz. \u00d6mer, Hz. \u0130bn Mes’ud, Hz. Ebu Hureyre ve Hz. \u0130bn \u00d6mer (Allah hepsinden raz\u0131 olsun) , \u00e7ocu\u011fun iki ya\u015f\u0131na kadar herhangi bir zamanda emzirildi\u011finde bu yasa\u011f\u0131n ge\u00e7erli olaca\u011f\u0131 g\u00f6r\u00fc\u015f\u00fcndedirler.
\n\u0130mam \u015eafii, \u0130mam Ahmed, \u0130mam Ebu Yusuf, \u0130mam Muhammed ve S\u00fcfyan Sevr\u00ee de bu g\u00f6r\u00fc\u015ftedirler. Ebu Hanife’nin de bunu destekler nitelikte bir s\u00f6z\u00fc vard\u0131r. \u0130mam Malik’de bu g\u00f6r\u00fc\u015f\u00fc destekler, fakat iki ya\u015ftan bir iki ay ge\u00e7se bile, bu yasa\u011f\u0131n ge\u00e7erli olaca\u011f\u0131n\u0131 s\u00f6yler.

O\u011fulun gayri me\u015fru ili\u015fkide bulundu\u011fu bir kad\u0131n\u0131n babaya haram olup olmad\u0131\u011f\u0131 veya k\u0131z\u0131n gayri me\u015fru ili\u015fkide bulundu\u011fu bir adam\u0131n anneye veya tam tersi bir durumun, k\u0131za haram olup olmad\u0131\u011f\u0131 konusunda da bir \u00e7ok ihtil\u00e2flar vard\u0131r. Bu meselenin f\u0131kh\u00ee incelikleriyle ilgili bir\u00e7ok kar\u015f\u0131t g\u00f6r\u00fc\u015f vard\u0131r. Peygamber'in (s.a) s\u00f6yledi\u011fi bir hadise dayanmaktad\u0131r: \\\"Kan\u0131n haram k\u0131ld\u0131\u011f\u0131n\u0131, s\u00fct de haram k\u0131lar...\\\" Fakat emilmesi gereken s\u00fct miktar\u0131 konusunda g\u00f6r\u00fc\u015f ayr\u0131l\u0131klar\u0131 vard\u0131r. \u0130mam Ebu Hanife ve \u0130mam Malik'e g\u00f6re, e\u011fer \u00e7ocuk en az orucu bozacak kadar bir miktar s\u00fct emerse, o kad\u0131n evlilik bak\u0131m\u0131ndan ayn\u0131 \u00f6z annesi gibi olur. Fakat \u0130man Ahmed'e g\u00f6re, haramlar, ancak \u00e7ocuk en az \u00fc\u00e7 kez emdi\u011finde, \u0130mam \u015eafii'ye g\u00f6re de en az be\u015f kez emdi\u011finde ba\u015flar. Ayn\u0131 zamanda, emdi\u011fi s\u0131rada \u00e7ocu\u011fun ka\u00e7 ya\u015f\u0131nda olmas\u0131 gerekti\u011fi konusunda da farkl\u0131 g\u00f6r\u00fc\u015fler vard\u0131r. A\u015fa\u011f\u0131da \u00e7e\u015fitli fakihlerin bu konudaki fikirleri \u00f6zetlenmi\u015ftir.:1) Hz. \u00dcmm\u00fc Seleme, Hz. \u0130bn Abbas, Z\u00fchri, Hasan Basri, Kat\u00e2de, \u0130krime ve Evzai'ye (Allah hepsinden raz\u0131 olsun) g\u00f6re, e\u011fer \u00e7ocuk s\u00fctten kesilmeden \u00f6nce emzirilir ve doyacak kadar emerse, ancak o zaman haram kural\u0131 ge\u00e7erli olur. E\u011fer s\u00fctten kesildikten sonra emerse, haram olmaz, \u00e7\u00fcnk\u00fc bu aynen su i\u00e7mek gibidir. Hz. Ali'nin (r.a) de bunu destekleyen bir s\u00f6z\u00fc vard\u0131r.2) Hz. \u00d6mer, Hz. \u0130bn Mes'ud, Hz. Ebu Hureyre ve Hz. \u0130bn \u00d6mer (Allah hepsinden raz\u0131 olsun) , \u00e7ocu\u011fun iki ya\u015f\u0131na kadar herhangi bir zamanda emzirildi\u011finde bu yasa\u011f\u0131n ge\u00e7erli olaca\u011f\u0131 g\u00f6r\u00fc\u015f\u00fcndedirler.\u0130mam \u015eafii, \u0130mam Ahmed, \u0130mam Ebu Yusuf, \u0130mam Muhammed ve S\u00fcfyan Sevr\u00ee de bu g\u00f6r\u00fc\u015ftedirler. Ebu Hanife'nin de bunu destekler nitelikte bir s\u00f6z\u00fc vard\u0131r. \u0130mam Malik'de bu g\u00f6r\u00fc\u015f\u00fc destekler, fakat iki ya\u015ftan bir iki ay ge\u00e7se bile, bu yasa\u011f\u0131n ge\u00e7erli olaca\u011f\u0131n\u0131 s\u00f6yler.3) \u0130mam Ebu Hanife'nin g\u00fcvenilir bir kaynaktan gelen s\u00f6z\u00fcne g\u00f6re, e\u011fer \u00e7ocuk emzirilme d\u00f6nemi boyunca, yani \\\"iki bu\u00e7uk ya\u015f\u0131na dek\\\" emzilirse, bu, yasak s\u0131n\u0131rlar\u0131 i\u00e7ine girer.4) Hz. Ali'nin (r.a) bir s\u00f6z\u00fc de bunu destekler niteliktedir. Urve \u0130bn Z\u00fcbeyr, At\u00e2, Leys bin Sa'd ve \u0130bn Hazm da bu g\u00f6r\u00fc\u015f\u00fc benimsemi\u015flerdir.39. Bir kad\u0131nla sadece nik\u00e2h yapman\u0131n, onun annesi ile evlenmeyi haram k\u0131l\u0131p k\u0131lmad\u0131\u011f\u0131 konusunda da ihtil\u00e2f vard\u0131r. \u0130mam Ebu Hanife, \u0130mam Malik, \u0130mam Ahmed ve \u0130mam \u015eafii, sadece nik\u00e2hlanman\u0131n da, o kad\u0131n\u0131n annesinin nik\u00e2h yapan ki\u015fiye haram k\u0131lmaya yetti\u011fi g\u00f6r\u00fc\u015f\u00fcndedirler. Fakat Hz. Ali'ye (r.a) g\u00f6re e\u011fer hen\u00fcz cinsel birle\u015fme meydana gelmemi\u015fse nik\u00e2hlayan ki\u015fiye, o kad\u0131n\u0131n annesi haram olmaz.40. Kar\u0131s\u0131n\u0131n k\u0131z\u0131, kendi evinde b\u00fcy\u00fcm\u00fc\u015f olsun veya olmas\u0131n kocaya haramd\u0131r. Allah, bu kelimeleri akrabal\u0131k ili\u015fkisinin hassasiyetini g\u00f6stermek i\u00e7in kullanm\u0131\u015ft\u0131r. Peygamber (s.a) bu konuda \u015fu h\u00fckm\u00fc vermi\u015ftir: \"Evlenmenin yasakland\u0131\u011f\u0131 ki\u015filerle zina eden herkes \u00f6l\u00fcm cezas\u0131na \u00e7arpt\u0131r\u0131l\u0131r.\" Bununla birlikte \u0130sl\u00e2m f\u0131k\u0131h alimlerinin bu konuda farkl\u0131 g\u00f6r\u00fc\u015fleri vard\u0131r. \u0130mam Ahmed, b\u00f6yle bir su\u00e7lunun mal\u0131na el konulmas\u0131 ve \u00f6l\u00fcm cezas\u0131na \u00e7arpt\u0131r\u0131lmas\u0131 gerekti\u011fini savunur. Bu yasak; hem \u00f6z, hem de \u00fcvey anne i\u00e7in ge\u00e7erlidir ve ikisi de haramd\u0131r. Bu kural ayn\u0131 zamanda annenin annesi ve baban\u0131n annesi i\u00e7in de ge\u00e7erlidir. Babas\u0131n\u0131n gayri me\u015fru ili\u015fkide bulundu\u011fu bir kad\u0131n\u0131n, o\u011fula haram olup olmad\u0131\u011f\u0131 konusunda alimler farkl\u0131 g\u00f6r\u00fc\u015flere sahiptirler. B\u00f6yle bir kad\u0131nla evlenmenin haram oldu\u011fu g\u00f6r\u00fc\u015f\u00fcnde olanlar, baban\u0131n \u015fehvetle dokundu\u011fu bir kad\u0131n\u0131n bile, o\u011fula haram oldu\u011funu s\u00f6ylerler. O\u011fulun gayri me\u015fru ili\u015fkide bulundu\u011fu bir kad\u0131n\u0131n babaya haram olup olmad\u0131\u011f\u0131 veya k\u0131z\u0131n gayri me\u015fru ili\u015fkide bulundu\u011fu bir adam\u0131n anneye veya tam tersi bir durumun, k\u0131za haram olup olmad\u0131\u011f\u0131 konusunda da bir \u00e7ok ihtil\u00e2flar vard\u0131r. Bu meselenin f\u0131kh\u00ee incelikleriyle ilgili bir\u00e7ok kar\u015f\u0131t g\u00f6r\u00fc\u015f vard\u0131r. Peygamber'in (s.a) s\u00f6yledi\u011fi bir hadise dayanmaktad\u0131r: \"Kan\u0131n haram k\u0131ld\u0131\u011f\u0131n\u0131, s\u00fct de haram k\u0131lar...\" Fakat emilmesi gereken s\u00fct miktar\u0131 konusunda g\u00f6r\u00fc\u015f ayr\u0131l\u0131klar\u0131 vard\u0131r. \u0130mam Ebu Hanife ve \u0130mam Malik'e g\u00f6re, e\u011fer \u00e7ocuk en az orucu bozacak kadar bir miktar s\u00fct emerse, o kad\u0131n evlilik bak\u0131m\u0131ndan ayn\u0131 \u00f6z annesi gibi olur. Fakat \u0130man Ahmed'e g\u00f6re, haramlar, ancak \u00e7ocuk en az \u00fc\u00e7 kez emdi\u011finde, \u0130mam \u015eafii'ye g\u00f6re de en az be\u015f kez emdi\u011finde ba\u015flar. Ayn\u0131 zamanda, emdi\u011fi s\u0131rada \u00e7ocu\u011fun ka\u00e7 ya\u015f\u0131nda olmas\u0131 gerekti\u011fi konusunda da farkl\u0131 g\u00f6r\u00fc\u015fler vard\u0131r. A\u015fa\u011f\u0131da \u00e7e\u015fitli fakihlerin bu konudaki fikirleri \u00f6zetlenmi\u015ftir.:1) Hz. \u00dcmm\u00fc Seleme, Hz. \u0130bn Abbas, Z\u00fchri, Hasan Basri, Kat\u00e2de, \u0130krime ve Evzai'ye (Allah hepsinden raz\u0131 olsun) g\u00f6re, e\u011fer \u00e7ocuk s\u00fctten kesilmeden \u00f6nce emzirilir ve doyacak kadar emerse, ancak o zaman haram kural\u0131 ge\u00e7erli olur. E\u011fer s\u00fctten kesildikten sonra emerse, haram olmaz, \u00e7\u00fcnk\u00fc bu aynen su i\u00e7mek gibidir. Hz. Ali'nin (r.a) de bunu destekleyen bir s\u00f6z\u00fc vard\u0131r.2) Hz. \u00d6mer, Hz. \u0130bn Mes'ud, Hz. Ebu Hureyre ve Hz. \u0130bn \u00d6mer (Allah hepsinden raz\u0131 olsun) , \u00e7ocu\u011fun iki ya\u015f\u0131na kadar herhangi bir zamanda emzirildi\u011finde bu yasa\u011f\u0131n ge\u00e7erli olaca\u011f\u0131 g\u00f6r\u00fc\u015f\u00fcndedirler.\u0130mam \u015eafii, \u0130mam Ahmed, \u0130mam Ebu Yusuf, \u0130mam Muhammed ve S\u00fcfyan Sevr\u00ee de bu g\u00f6r\u00fc\u015ftedirler. Ebu Hanife'nin de bunu destekler nitelikte bir s\u00f6z\u00fc vard\u0131r. \u0130mam Malik'de bu g\u00f6r\u00fc\u015f\u00fc destekler, fakat iki ya\u015ftan bir iki ay ge\u00e7se bile, bu yasa\u011f\u0131n ge\u00e7erli olaca\u011f\u0131n\u0131 s\u00f6yler.3) \u0130mam Ebu Hanife'nin g\u00fcvenilir bir kaynaktan gelen s\u00f6z\u00fcne g\u00f6re, e\u011fer \u00e7ocuk emzirilme d\u00f6nemi boyunca, yani \"iki bu\u00e7uk ya\u015f\u0131na dek\" emzilirse, bu, yasak s\u0131n\u0131rlar\u0131 i\u00e7ine girer.4) Hz. Ai\u015fe'ye (r.a) g\u00f6re, ya\u015f s\u0131n\u0131r\u0131 olmaks\u0131z\u0131n ne zaman emerse emsin, ki\u015fi bu yasa\u011f\u0131n s\u0131n\u0131rlar\u0131 i\u00e7ine girer. Hz. Ali'nin (r.a) bir s\u00f6z\u00fc de bunu destekler niteliktedir. Urve \u0130bn Z\u00fcbeyr, At\u00e2, Leys bin Sa'd ve \u0130bn Hazm da bu g\u00f6r\u00fc\u015f\u00fc benimsemi\u015flerdir.39. Bir kad\u0131nla sadece nik\u00e2h yapman\u0131n, onun annesi ile evlenmeyi haram k\u0131l\u0131p k\u0131lmad\u0131\u011f\u0131 konusunda da ihtil\u00e2f vard\u0131r. \u0130mam Ebu Hanife, \u0130mam Malik, \u0130mam Ahmed ve \u0130mam \u015eafii, sadece nik\u00e2hlanman\u0131n da, o kad\u0131n\u0131n annesinin nik\u00e2h yapan ki\u015fiye haram k\u0131lmaya yetti\u011fi g\u00f6r\u00fc\u015f\u00fcndedirler. Fakat Hz. Ali'ye (r.a) g\u00f6re e\u011fer hen\u00fcz cinsel birle\u015fme meydana gelmemi\u015fse nik\u00e2hlayan ki\u015fiye, o kad\u0131n\u0131n annesi haram olmaz.40. Kar\u0131s\u0131n\u0131n k\u0131z\u0131, kendi evinde b\u00fcy\u00fcm\u00fc\u015f olsun veya olmas\u0131n kocaya haramd\u0131r. Allah, bu kelimeleri akrabal\u0131k ili\u015fkisinin hassasiyetini g\u00f6stermek i\u00e7in kullanm\u0131\u015ft\u0131r. Bir adam\u0131n kar\u0131s\u0131n\u0131n k\u0131z\u0131n\u0131n, kendi evinde b\u00fcy\u00fcm\u00fc\u015f olsun veya olmas\u0131n o adama haram oldu\u011fu konusunda g\u00f6r\u00fc\u015f birli\u011fi vard\u0131r.41. Burada \"sizin sulb\u00fcn\u00fczden olan\" ifadesi, evlatl\u0131k olarak alan\u0131n o\u011fullar\u0131n dul veya bo\u015fanm\u0131\u015f e\u015flerinin de\u011fil, sadece kendi o\u011fullar\u0131n\u0131n kar\u0131lar\u0131n\u0131n kendilerine haram oldu\u011funu belirtmek i\u00e7in kullan\u0131lm\u0131\u015ft\u0131r. Ayn\u0131 \u015fekilde erkek torunlar\u0131n\u0131n kar\u0131lar\u0131 da haramd\u0131r.42. Bir ki\u015finin; han\u0131m\u0131n\u0131n teyzesi, halas\u0131 ve \u00f6z ye\u011fenini han\u0131m\u0131 ile birlikte nik\u00e2h alt\u0131na almas\u0131 haramd\u0131r. Bu prensip \u015fu \u015fekilde geni\u015fletilebilir: Erke\u011fe kendi akrabalar\u0131ndan, kendisine haram olan kad\u0131nlar\u0131n, han\u0131m\u0131 taraf\u0131nda benzer konumdakileri de han\u0131m\u0131 ile birlikte nik\u00e2h alt\u0131nda bulundurmas\u0131 haramd\u0131r.43.
